Default Boundary Dispute Info

The dispute hasn't happened yet, but a comment has been made about the position of the fence between us and next door. I'm just getting all my info together before it really starts, which makes it easier if anything does kick off.

The fence has been up a while (the nephew of the guy who did the work is coming round tonight to give me dates, previous boundary lines etc) how long does it need to be up for before I can say 'tough, it's staying where it is'
Also, looking out of the back of the house towards the garden, am I responsible for the left or right hand fence, or is it not that clear cut (row of terraces btw)

I don't intend to go down the 'bugger off' route, but if I have the option then it will seem more accommadating if I let them move it a bit if it doesn't really effect me.

Do you actually own the land its on? or does that not make a difference after so many years?

The answer largely depends on whether the land which you are claiming is registered or unregistered. It is much more difficult to claim adverse possession if the land is registered. If you PM me the address of the property I'll check with the Land Registry.

I believe they are both registered (adjacent gardens).

my deeds state I am responsible for the right hand fence looking out the back door. Many years ago, I replaced both, as the folk on the left were chvvy gits who let their kids destroy the first, and they ran amock all over my plants. The neighbours now on the left are pretty reluctant to do anything about it, evn though its rickity. I don't see why i should do it again, but am willing to compromise. maybe if they looked at all the gardens and whose replaced which, they would get the message!!

tbh that's quite useful (it's the RHS fence) as it prevents them doing it off their own bat. Although I'm not convinved they will.

Like I said, this is really just a data gathering exercise before anything starts.

French would be easier, then they'd just surrender.

Upate, fence in question has been up for a minimum of 15years it has been put round the outside of the old toilet block for the row's boundary. Apparently there is still the sewer and manhole underneath the raised bed the fence had been put around.

I'm still planning on being amicable about this, may let them move it then they can sort out the problem with the old drains.

Good bit is that I don't own the fence it seems so it'll be of no cost to me.
