Default Where do I stand with??

Damage to my car caused by a product used in the wrong sittuation.

I was reversing out of a space at kittens uni yesturday and in order to do this you have to turn and reverse.. there was a laid flat yellow parking prevention pole which cought under my wheel as i went over it ( you have no chice but too and you cannto see them to avoid them when revesing) which flicked up damaing the wheel arch liner and then came back up and smacked my front bumper cracking it and putting scratches in it?

there are signs up saying they aitn liable for any damage, but these were but there after this sign. Further more i know for a fac tyou should have 6 m cler reversing space to get out of a space without having to turn which these , drop down poles make make it impossible to revese out in a straight line!!

Im spitting feathers, it was on the market now it has to come off and theres nearly £300 worth of parts alone that have been damaged, thats if i swap them all over.....!

the security gaurd was very wuick to point out they were not liable but iv got a funny feeling they must be somewhere, whats more i bet they are going to try and charge me cause it pulled the post out of the tarmac!

Have a word with Ed,our resident legal eagle.My guess FWIW is that "not liable"disclaimers are not worth the notices they are written on.If they had a negligent design or structure in the car park they are liable,much like a burglar can sue you if he gets hurt raiding your house if your rotten ladder breaks while he is using it.

IMO The signs are there to stop then being sued when somebody runs into your car and does a runner or if you get your windows put in and your stereo nicked. No amount of signs can get them out of their responsabilies regarding making sure the car park is fit for purpose and well maintained. The way I see it things would be no different if a faulty car park barrier came down on top of your car and trashed the roof. Car park owner is to blame.
