View Full Version : Legal or illegal cans?

A good friend of mine was selling a can that he had on his SV650, said it sounded really good and increased perfomance (very slightly), said it was easy to fit etc etc so I took it off his hands, went ahead and fitted it with no problems at all, when I started the bike up I nearly fell over in shock at how loud it was (some might disagree but the louder the better for me).
I've spoken to a few people in 'the know' and im getting mixed replys about if its road legal or not, would it pass an MOT, do I keep it or put the original back (which I have kept).
Advice please.
Mick
PS anyone in cannock or staffordshire on SV650.org ?????????????
:rave:
Is it 'E' marked?
Has it got 'NOT FOR ROAD/HIGHWAY USE' or 'RACE USE ONLY' stamped on it?
Has it got the facillity for a removable baffle?
I run mine without the baffle, It's LOUD. But I like it.
PLUS people in cars can hear me coming which can only be a good thing.
Personally, because of the low-down frequency of a V-twin, I think the noise they make is not really intrusive. Unlike a screaming 15000rpm IL4 engine.
With regard to MOT, check all of the above, (E mark etc), If it has a removable baffle and is a road legal type, then when it comes to MOT time, stick the baffle in and you should be fine!!

or use a decent tester who regards loud cans as an essential safety feature.
remember there is no noise test done for an MOT or e mark required

EXACTLY!!!
Although someone posted on here the other day about a 'tester' peeling some tape off of his exhaust to expose the "NOT FOR ROAD USE".
That tester should be forced to go on a refresher course.
Most Bike Testers I know, ride bikes anyway and are level headed about these sort of things!!! ;)
I have a very loud illegal can that had "not for road use" stamped on it. It failed its mot for this reason, but after some advise on here the same exhaust passed the retest and noise was not an issue for the tester. As long as the tester can't see any markings then it's at his discretion whether he passes it or not.

Not strictly true, the sound comes from the back of the bike and travels backwards...the bike travelling forwards towards a car with the windows shut and the radio on..
Sorry but loud cans dont save people, they sound nice:cool:

I disagree - the traffic behaves like the parting of the waves ;-) when I'm on the SV with Scorpion - baffle out - totally the opposite on my Bandit with road legal Micron Can - definately can see a big difference
I also notice when I'm in the car that I hear loud exhausts coming up behind - but not quiet bikes :D

Have you not thought that if your filtering through traffic then people sat there going nowhere will be more likely to see you in a wing mirror?
And as a bike rider sat in a car, your more likely to be on the lookout for other bikes anyway.
Did a search and found loads of other people discussing it too:-

But as for the OP, if you fit a sports can, keep the standard one too as the plod can get funny about it.

How can I hear my bike 'coming' when my mate rode it then???
Also, people hear it when you're filtering because you're right next to 'em.

Thanks guys, I did look for markings but couldnt see anything but I shall have a closer look next time I go out. All the advise you lot have givin me is kind of what I have been told before. One guy said as long as it does'nt 'clearly' state "NOT FOR ROAD USE" and it had a manufacturers name, then its legal. Someone else said that its up to the MOT station if they do or not.
With reference to the baffle from Speedy, I can not see any where a baffle can go and there was definatly not one given to me, I have emailed my mate that sold it to me to make sure he never had one when he brought it new.
Thanks again guys for all the advise and info.

Thats not true, just cause my exhaust does not say "not for road use" any more does'nt make it legal, it's still a race system. There are markings on legal systems that let the police know they are legal, any thing else then its at the discretion of who pulls you. You should also let your insurance know so it does'nt void the bike in case of a claim. My insurance were fine about but they did want it on record.

My Scorpion had no baffle in it and no hole to secure one. All I did was to buy one of those DB killers off Ebay and drill hole in the underside of where the pipe comes out of the silencer. The DB killer has a nut welded into it.
Piece of cake and bike has passed 2 MOT's now. Can is not too loud to annoy the neighbours either
A picture of the exhaust and of the end port would help :)
I have an Akrapovic Race System on mine and have twice forgotten to put the baffle in when MOT time rolls round. It has yet to fail it.
I guess a lot depends on where you go to get it done, but I admit that the pipe still has the E mark on it.

I totally disagree with this too.
Having gone from a SV1000 with straight thru yoshi's to to a striple with standard cans, alot more people used to move over a few cars ahead when i was approaching.
The sound will re-verb fowards if filter on the motorways too so it will help.

I will get some pic's done soon, I have noticed though more cars moving out the way as you approach them from behind, especially in built up areas. thanks again for all the advise.

Errr...yes they do. A bike with a louder can is more likely to be heard than a bike with a quieter can. This equals road users attention being drawn to the fact that a bike is coming.
I have a hearing impairment and drive a car with my windows shut and ocassionally have the radio on. I can promise you that I hear the louder bikes coming way before seeing them.

Yeh I agree with that too, my parents said its a bit loud but its an additional safety features.

I have an ART can with no baffle in it and a "band" riveted on with the AEU official thingy blah blah.
Mine failed an MOT last year for not having a baffle in - got a DB Killer and it passed. Took bike for MOT last month with DB in and got told by the tester that it made the bike sound sh1te and i should rip it out. :D

I agree sv650nutter149 (although my neighbours might not.....ow well) I have done some pictures which I will post on here soon.
Spoke again to the guy who sold it to me and he said when it was on his bike the MOT guy tested it and passed it but added an advisory notice about the noise level. Is that standard practice???
