View Full Version : Solicitor name and shame, and a thumbs up
I had an off in March last year and to cut a long story short, a mini-bus taxi did a u-turn in front of me while I was overtaking a very long traffic jam. This was my very first accident as a car and bike rider so I didn't have much of a clue as to what and how things happen after the event. So, my insurers got Michael Halsall solicitors to take my case on. And from the first phone call with them I was advised that I would almost certainly be at least 80% liable for the accident (quoted Powell V Moody ). The amount of time and effort I have spent trying to get them to work for me got me totally peed off by December so I looked into what I could do about it and I found that I could change solicitor at any time if I was unhappy with the service. So I did just that. Having searched about a little bit I came across White Dalton (who I have seen mentioned several time here). Today I got a call from Mr. Dalton himself to say that I have a very strong case and that he was going to be representing me in court, and that he will be going for a 100% outcome (Davis V Shrogin) in my favour. He has explained what and how things we be developing and has done more for me in the space of a few weeks (with a Christmas holiday inbetween) that Halsalls did in nine months! He couldn't believe how much work I had had to do and set my mind at rest over his comitment to getting a result for me.
So. If you are unfortunate to get into a claim situation, make sure that you contact a dedicated motorcycle claims firm to deal with it. For me White Dalton win big points, but I'm sure that there are others that will do a good job too. And stay away from Michael Halsalls. As Mr. Dalton quite rightly pointed out - Halsalls have to buy their cases from insurers, White Dalton don't need to.
Now I just need to wait for a court date and see what the defence come up with :smt062

Since we're naming and shaming - comercrawley in norfolk.
2 years to get a result, unhelpful and didn't bother to ring the witness who changed his number in the time inbetween.

Since were naming and shaming...
White dalton were and still are failing to return my calls and emails even though I'm paying for their "services".
They gave me the same old talk about others buying their cases too..
Shame I don't do personal injury. But I'd be way out of my depth, it's not something I've ever done. And as for paying these claims farmer ambulance chaser people for work:rolleyes:

I have used two legal firms in the recent months and the thing I have found with both is
1] Be truthfull and honest ,do not exaggerate
2] Provide as much evidence as possible, whether relevant even what may seem
irrelevant to you may be important to your case
3] Research your defense and bring your findings to the attention of your solicitor
This has enabled me to win on both accounts
This has enabled me to win on both accounts
What, not because you were in the right?
3] Research your defense and bring your findings to the attention of your solicitor
Erm..... isn't that part of the solicitor's job and what you are paying for?
Dogs and barking oneself springs to mind.

You have the right to expect that any solicitor who specialises in a certain aspect of law should be up to date on the relevant case law.
Many bikers are well aware of the unfair Powell Vs Moody and how it had been applied to motorcycle filtering claims. We therefore applauded Davis V Shrogin. With such a fundamental change in how filtering calms were settled, specialist solicitors should know it.

Yes I was in the right but-- 1] contested by the police 2] contested by the other parties insurers
Yes it is the solicitors job but their time costs me money and if I provide the bullets they can fire the gun.
If I had the know how and the same regard as a solicitor in the court concerning presentation and procedure I would have defended myself, but although we are equal in the eyes of the law we don't seem to be in practice----hence solicitor/barrister

Sorry to hear that mate. I guess every company has its down side but I have been very impressed with them so far. They seem very committed to my case.
Nice plug Ed
Tim - You wouldn't believe how many calls and how long I had to fight for to get Michael Halsalls to even listen to the possibility of looking at the Davis case. The guy handling my case wasn't having any of it. I was doing all the case research myself.
Stu - What, not because you were in the right?
Unfortunately it doesn't seem that straight forward in reality.
