Ok... Im still gobsmacked at what happened this morning....
riding into work, get to Commercial Street. Across a set of lights, following behind a goldwing. Approaching a pedestrian crossing, green lights so carry on....

however, Ive spotted a van trying to turn right ie into my lane.... so slow down as hes edging out... he stops... the goldwings carried on and hes definitely stopped and can see me so I carry on then he goes right in front of me...
I had no chance... :evil:

Ok... bike slides under van a bit... I got catapaulted off the bike over the handlebars... landed on my face to the right (judging by the scrapes on the helmet and the impact on my right side) :shock: slide a bit...

when I stop and sit up the guys got out the van and asking if Im alright. Im looking at the bike gushing petrol and oil over the road... then guy gets back in van and goes to start it and seems to want to drive off... by this point the goldwing rider is over, sees whats happening and goes to get the keys off him...

manages to do so, then the van driver goes nuts... he then punches the goldwing rider causing him to fall in the road into the path of an oncoming lorry which fortunately could see the accident and was stopping anyway :shock: :shock:

van driver is still going for the keys and going ballistic so the goldwing rider throws them across the road towards me... I pick them up. Because the drivers going nuts I call 999 to make sure theyre on their way.

At this point the driver comes after me and starts pushing me... he goes to hit me and Im screaming (with the phone connected to the police - nice evidence methinks) because he goes to hit me to get the keys back. :shock: I get cut off from the police at this point because hes grabbing me to get the keys...

Im practically hysterical at this point, Im injured and the guys damn well assaulting me... fortunately this is where 4 cso's arrived - and damn glad to see them I was too... they seperated us, I gave them the keys and they moved the vehicle.

But at least they saw the scene as it was and he was kept there. The driver behind me, the goldwing rider, the car on the other side which the lorry had blocked have all told the police the same thing - I had no chance.

He said I was doing 60... I like this... I was speeding he says so infer he saw me... saw I was speeding and still went... mmmm think that wont cary any weight given I was doing 20... the car behind and goldwing gave statements to that effect to the police at the scene. The guy was arrested and taken into custody.

So will find out what happens soon... the goldwing riders certainly pressing charges with so many witnesses (me, car behind me, the lorry he fell in front of with 3 people in the cab). The officer speaking to me in the ambulance said theyd all confirmed my story and that they would be considering reckless/dangerous driving.

As for me, battered & bruised... but no breaks fortunately. Im alive which is the important thing. The bike I dont know about... kept asking but they told me it had been recovered and I could sort it out later when Id been checked over.

Why is it, no matter what, you always worry about your bike? I was in a neck brace being tied down to ensure if I had neck injuries I wouldnt aggravate them and all I wanted to know was what was happening to my bike? :shock:

Massive thanks to Ian (Sid Squid) for talking to me when I needed someone to keep me on track and for helping me out this afternoon. Thanks Mr Toad too. Just needed to talk to someone cos Im still a bit shaken.

JBs theory of the God of Off is scary. I nearly had a similar accident wednesday when someone did almost similar thing.. had a feeling one was coming.... Still this is my first major off in 4 years of riding... learnt a few lessons today which will add to my experience and hopefully keep me on a bike for a lot longer yet.....

See the rest of you guys tonight... bikeless but I'll be in soho...

Bloody hell... Nothing's a worse trigger than someone knowing they've f***ed up I think, I see that all the time in my work... The people who don't have a leg to stand on are always the most aggressive, since they seem to think that'll convince people they're in the right. Look on the bright side, you have the clearest-cut insurance claim in the history of the world.

The bike'll fix, the main point is that you don't need fixing...

Lyn that must have been somewhat terrifying and you have my utmost respect for how you handled it. This is the sort of person that I'd like to see tied to a pole and whipped, what a total b*stard. If you need anything just let me know - and a big thumbs up to Squid and Toad for assisting you.

Once you get his vehicle reg let's name and shame him so that others can stay out of his way - or maybe invite him down to Soho for a little "chat".

still a bit shaken up... believe it or not the most terrifying part of it all was him going for me...

not the summersault over the bars, landing on my face and sliding... I accept things like that could happen riding a bike but the guy going nuts was just unbelievable...

theres issues with the bike - dvla have screwed up the ownership docs so theyre now looking at it to make sure its not a ringer before I can get it back

I was so glad the pcso's were there... they got there pdq actually... which is really fortunate because they stopped a bad situation getting worse....

I know you guys do a good job, its just the rest of the world seems to see you as motorised traffic wardens... but hope this points out that youre not... they took control, ordered the ambulance and chased up the police officers getting there...

and yes the goldwing rider will pursue this, now I remember, he was injured in the fall and bleeding so there are notes from the ambulance crew and cso's that he was also injured.. cant remember much else because they packed me away in the ambulance after that :evil:

they were trying to get me to calm down - my pulse hit 145 at one point and wasnt dropping... funny cos they tested me and it read 100 and then started going up... well what do they expect if they send hunky paramedics??!! :wink: :lol: :lol: :lol: :lol:

I seem to remember laughing a lot with the ambulance crew :shock: and talking about sv's - the driver had had one once... funny how shock affects people isnt it?

I hope they throw the book at him. However as he tried to drive off I guess he has either no licence insurance etc. So anything less than a public flogging is unlikely to deter the git from repeating his actions.

How's the colour of the bruises now? Hope you're hand isn't the size of a melon. Good to see you last night.

Try to keep everything moving as this will help, and I'd consider a trip to a physiotherapist anyway (you never know you might get a hunky one) to just check you over and give you some advice.

Hope you're back on the road soon and the train home wasn't too crappy

Lyn, I'm so glad you're OK, and Isaac sends his love. Keep an eye on yourself for aftershocks and let us know if there's anything we can do to support you in any way.

Having heard a few similar stories recently where a situation's kicked off. Having listened and learnt what to watch out for, I guess this was the ideal outcome, with everyone reacting just as we'd all wish (apart from the tw@ van driver, of course). A reminder to us all to be wary and aware of what's going on around us not just in the crash itself but in the aftermath.

Big up to the Goldwing rider for looking after our girl - that's why I'll always be proud to be a biker. I guess he's now an honourary member of the Soho Massive whether he knows/likes it or not.

Hi,

Im really overwhelmed by all the support you guys have given me. It means an awful lot.

Right now I hurt like hell. My right arm is bruised from elbow to fingers. My left quad muscle is strained and am having interesting moments walking when my ankles and shins kind of draw my attention to the fact they want some ow time too..

To be honest, although I hurt a lot its not as much as I thought it would be after speaking with Mark at Soho... and Im considering myself exceptionally lucky. Not many people go in a side of a van and walk away with bruises and muscle strains - case in point the post last week about the guy who went through the panels of a van.

Im still upset by the post accident behaviour Still have to report it to Customs - be interesting when his work get notification he was in an accident and assault of a vat inspector :twisted: :twisted: :twisted: :twisted: :twisted: :twisted:

Havent heard from the police as yet - though I suspect he will have been charged with the assault at the least.

Insurance has been a bonus - have legal cover which I didnt think I had and theyre out for everything - all my costs, injuries, time off, recovery etc etc. Possibly get replacement bike sometime this week out of it too. As for the cbr - didnt look bent but who can tell.

Looking to pick it up tomorrow/wednesday to be taken to mates workshop in Northampton. Then the insurance will recover and inspect and let me know. Might even get to see what state my SVs in too.

Im on library pc - not up to work yet - so not much time, but just wanted to thank you guys for all the replies. Means the world to me.

I have the goldwing riders email so if anyone wants it pm me and I will give it out but probably best if we dont overwhelm him :lol: .

Will try and get back online tomorrow or wednesday depending on when I can pick bike up.

Still, all that petrol coming out of the bike must've completely ruined the lovely paint job on your tank - I expect it'll need a total respray now eh?

Don't worry if he's not insured - the Motor Insurance Bureau will have to pay if he's not.

This reminds me of a similar incident my other-half had a month or so ago. Just so you know you're not alone ...

We live in a fairly narrow road which usually has parked cars all down one side. My missus is driving up the road (with the parked cars on her left) and she spots a car stationery in the road. On closer inspection she can see that there is a van (coming in the opposite direction) which, rather than waiting, has pulled up onto the pavement with two wheels, leaving barely enough room for the oncoming traffic to get through. The car in front slowly creeps past the van and my missus notices 'van man' saying something to the lady as she crawls past.

My missus has the window open so she can check the offside wing as she now attempts to crawl past this cretin. As she slowly drives by, he starts having a go at her through the window - like it's HER fault! Anyway, before she has got fully past the van, he decides he's had enough and accelerates at speed off the pavement and onto the road and off he goes. As my missus is about to carry on, a woman in a car behind starts beeping her horn. When my missus gets out to see what the fuss is about the woman explains that the van had caught our car as he drove away. On inspection, there is a very slight scuff.

Now my missus is not the shy retiring type and, knowing the road was a dead-end, goes after the van driver to ask him for his details. When she approached him he went BERSERK! He's yelling at her, threatening her with physical violence etc. etc. My missus is dumb-struck and not a little shocked by the whole thing.

"You better watch out, I know where you live!" were his parting words as she decided she wasn't going to get anywhere with the moron.

Needless to say, she reported the incident to the cops and, given the damage to our car was so minor - easily removed with a bit of T-Cut - she didn't bother our insurance company.

She was so shaken up by his aggression, however, that she rang me at work, in tears, and I ended up going home to comfort her.

We had forgotten all about it until a couple of weeks ago we got a letter from the police. They wanted full details as she'd failed to report an incident and left the scene of an accident without leaving her details!

Turns out he had gone to the police station that evening and told them that SHE had hit HIS van causing significant damage, and then failed to provide details at the scene!

Luckily the police have the whole story - and a record of her call concerning the incident - immediately after it happened - so we are not expecting anything to come of it.

She is sure that had she pushed him to provide his details, he would have got physical - seems she made the right decision to leave the tw@ to it.

Can't believe he has the cheek to claim against her though!

Sorry to "bump" this, but I've had a message from the Goldwing rider, text below:

"Thanks for the messages, and I do really appreciate the comments.
It's the sort of thing I have been doing for most of my adult life, firstly in the Navy, then for 25 yrs as a fireman, and more recently in Fire Safety, always prepared to help when inicidents happen that need some help.
So Lyn was on the wrong road at the wrong time and got clobbered, but luckily, not too severe. I could see that she was heading for big trouble when white van man started to ease out, and fortunately, our speed was low enough to avoid big collision damage to Lyn. I know that, in hindsight, I may have been reckless in what I subsequently did, in taking the keys from the van. He could have been armed !! Anyway, I stupidly thought, who would thump a pensioner, or a female who had been injured because of someones stupid driving? I now know, it is white van man.
We were also lucky in that in the following car was a retired policeman, who carefully observed and told police in attendance of all he had witnessed. I will be thanking him in due course.

FYI, I escaped serious injury, just a spained wrist and some cuts, enough for the Docs to fit me with a splint. However, that evening I was due in Worthing for the Clubs Chrissie party, and arrived in a splint. You can guess what they all thought. Had I fallen from my bike? No way !
Later in the evening, "post traumatic stress" got me, so had a little faint, but friends saw it coming, and had a Scotch ready for recovery!
Today, I could not ride my bike to the Ally Pally bike show, so went by car, where I was working on the BMF stand. I will be there again on Thurs & Fri, so if you are coming, stop by for intro's, and look forward to hearing where in Frith St I can find you lot.

Further, I seems as though the van driver is well known to the Police and is not a nice person at all. And the whole incident was caught on CCTV...............

What are the usual arrangement for Frith St as I think he'd like to pop along? :D

I didnt realise the guy behind was a retired policeman... or the goldwing rider an ex forces, ex fireman... oh dear... van drivers in a bit of grief as far as credibility of witnesses against him go... me being an upstanding officer of HM Customs & Excise too... :twisted:

Im still in shock by it all... although the bruises are turning a lovely shade and the aches are easing a little today...

I still havent heard from the police - will call them later and will have him charged with assault on me.

Aside from that, spoke to one of my law enforcement mates last night - just to see if he could also be charged with assault on an officer of HM Customs - carries a mandatory jail term longer than a usual assault...

he was telling me that even if the cps dont do him criminally for dangerous driving I can still pursue it civilly...

But I didnt think things would get like this... all I kept doing was telling him he wasnt moving the van til the police got there... didnt think I would have personal safety issues... :shock:

I just know how hard it is to prosecute someone when the police do it right and I knew if he left the scene we'd never get a successful prosecution or resolution insurance wise and I just got into bossy vat inspector mode and kept telling him hed get his keys back when the police got there... :shock:

I thought there would be CCTV... Oh well, good start for the next series of police camera action I reckon... :shock: :wink: :lol:

thanks again everyone for the support... its made a difficult situation more bearable... its hard to believe Ive only been on the forum since the end of November, but your friendship and support, especially in this situation has been overwhelming... I love you guys...

I too have just caught up with this. Really am amazed at the way some people behave... If he was an animal they'd shoot him. Personally I think he needs his needs the palms of his hands smoothed out with a hot iron !

Glad to hear you're OK though, you never know, they might write off the CBR and you can then look for a bike with an even worse paint scheme :lol:

just a quickie... got the bike to workshop in northampton...

bent forks and broken fairing appears to be only damage...

I still ache but getting better...

and still wondering how the hell one person gets so lucky to escape with bruises and strains and a bike thats reasonably intact... hmmm indestructible hondas eh?

bikes relatively ok... its really only forks damaged and front fairing (what was left of it) damaged... where its run on its side theres oil somewhere there shouldnt be...

reckon my mate dispairs giving me the technical explanation and me going its the thingy on the thingy to everyone else... been a bit of an airhead this week.... ok ok more than usual all right? :lol:

considering its going to be a naked cbr... (thats a hornet isnt it?) considering streetfightering it but to be honest may just leave it naked...

theres 2 seperate investigations - 1 for the accident and 1 for the assault. Apparently no-one saw the punch and the drivers saying he pushed him over. All people saw was the raised hand. I seem to be the only one who saw it. Im giving a formal statement and finding out what charges I can press next week when Im ready to do it - so monday basically.

not updated on the accident but should get that next week. Was told while there was cctv it was all pointing the wrong way so none of its on tv.. :shock: :evil:

hmmm obviously back in biker mode, talk about bike first and serious stuff 2nd :roll: :lol: :lol: :lol: :lol:

oh and im now achy but moving... insomnia due to the stress is my biggest issue... not slept properly since saturday...

Ok... well the police have now decided to do all the charges in one go so we're back on one investigation. A very nice policeman has just been to see me at work to give me the forms required for my formal statement. As Ive worked for the crime squad before Im allowed to do my own witness statement because Ive written shed loads before.

Ive been talking to him and hes told me a little about the drivers interview - apparently Ive done this to commit insurance fraud.. :shock:
according to the driver, I deliberately rode into him so I can sue and get shed loads of money :shock: :evil: :evil: :evil:

My recollections to him just now are apparently confirmed by the other witnesses statements. It appears there are a total of 6 witnesses as well, my statement will be the third. Hes also aware of the CSOs so will get their statements and now aware of the CAD recording of my 999 call.

The driver is on bail, and due to return to be charged in 2 weeks. They are looking at common assault for me and the goldwing rider aswell as various traffic offences. I also have to do an impact statement on the effects of this for court. Ive basically been told this will go to trial.

keep you updated when I know more....

They are idiots some people. One of my accidents, the guy said i didnt run into him, i'd slipped off and the bike had hit him and therefore he should be claiming off me.....

I only have his name and the van reg... they cant give me all his details and his insurance have to go via my boss at work... his company insurance people will be happy with the address... City VAT Office... :twisted:

actually that could be an issue... what if I get given the visit to the company?? hmmmm need to look into that...

... but you had right of way, so even if it was an insurance scam that doesnt take away the fact he caused the accident damaging you and your property, no?

Jordan - basically the police are treating that allegation with the consideration it deserves and recognising the fact that the guy is just trying to divert attention from the fact hes guilty of dangerous/reckless driving. Im still just completely gobsmacked at the dopiness of the driver... :shock:

If the proceedings go to court, he will be charged and taken to magistrates court for a plea hearing. If he goes not guilty, I think these charges mean he'll be tried at a crown court rather than it all kept in magistrates court. Fraser or Gforce may be able to confirm if Im right.

All of these are public hearings so if we get there, dates/times and location will be posted here....

If it gets there and I have to give evidence I will appreciate anyones company and support at that time.

Thanks for your concern over my other-half. She's fine - so long as the git doesn't try any new 'angles'.

It would be really nice to see this twerp get EVERYTHING that's coming to him - make sure you press it all the way, and don't forget to claim for your distress, loss of sleep etc.
