Default RTA where party refuses to give details

Just had an accident (in car) where the other party was agressive (why, isn't this what insurance is for?) and refused to give details, i.e name, address, insurance company, name of policy holder etc. He got my details. All I got was his number plate.


Is this legal?

What can I do?


(oh and accident may be cut and dried - against me!!)

Should call the Police if either party, wether it was their fault or not, refuses to give details.

I think it means things like name and address, phone no. You don't have to give insurance details.

Wife was driving. Stupid thing was - wife rear ended him coming off a mini roundabout! - Cut and dried as far as I can see.

He got in his car after snatching out details and screwing them up in a ball, tossing them in his car. His parting words were "You'll be hearing from my insurers" I don't think he heard the "On the contrary" remark

He had got out of his car when he was hit, all agressive. The wife says "Calm down it's only a bump" he continued all agressive and says "Why are you laughing?" . the wife says "I'm not, I just don't see any reason for your agression!" and smiles. He says "I don't like your smile" Wife? "Now I AM laughing!"
He demands details, she shes OK and says, "Can I have yours?"
The Prat says, "Once you have given me yours" (What is this? I'll show you mine time?) She writes ours down, he storms off without giving us anything.

I believe it to be a legal requirement to hand over your insurance details in the event of an accident. If it were me, I'd nip down to the local plod station, disturb their tea and biscuits, and make a formal complaint. And get a crime number (if one has been committed).

At least this way you've covered yourself.

This sort of behaviour does tend to suggest that the driver wasn't insured. Good luck.

So far I have 3 other accidents where the other driver wasn't insured.

One lied for an unknown reason and hit me from the left on a roundabout. One was a scrote with no insurance driving like a twit (wrote off the wifes car and damaged mine - pushing the cars into the front of the house by skidding into parked cars) and the third was driving her other halfs car without consent and rear ended us.

Seems like I find these drivers! - Result - 3 claims where the other party cannot be claimed for - hence "My fault" and I have a crap no claims bonus in the car.

If you've already ot the attitude that iwas your (wife's) fault, then there can only be an upside.
What Jonboy said - can only be good for you that they left without giving name & home address.

Jonboy - Pedantic point alert I thought it was just name & home address which seemed reasonable to me as you might not know your insurance details?
