On the motorway when lane 1 becomes a filter lane and only lane 2 and 3 are carrying on as the motorway.
If you are leaving the motorway and using the filter lane can you pass (undertake) the slow lorries and stuff that have moved into lane 2. Or is this classed as undertaking and very naugty? |

As I understand it - if the lane to your immediate right is bumper to bumper slow moving traffic then to undertake is not illegal. If you're also on an exit slip, leaving the carriageway (short line, short space), then you're ok.

The law says it is illegal to undertake, unless of slow moving traffic under 10mph, or unless the lane is clearly seperated from the motorway your on...
I.E A2 users, its 3 lanes, but the inside lane comes off as a sliproad, (so 2 lanes), then the inside lane re-attached on the joining sliproad. However, this inside lane, as it is its own sliproad, is marked as a seperate lane by the white lines on the road, so going by "the law", yes you can undertake, and re-join, as long as you don't break the speed limit. Grey area.. Like acceleration. You can accelerate as hard and as fast as you want to, as long as the wheels do not loose traction or you break the speed limit. Had many an argument with coppers over that one in the car..... tbh, i used to do the "inside lane" trick every single working day for 8+ years without being pulled for it. |

Undertaking is not illegal however if you have an accident it will be taken into account (treat it as filtering). As long as you are safe and cautious you wont have any problems.
Using a slip-road, it wouldn't even be deamed undertaking as that lane is heading in a different direction to the carriageway. I got stopped for speeding not so long ago and even though I'd undertaken at speed (3 lane dual carriageway with only 1 vehicle in the outside lane!!) because I had done it safely, the traffic cop never even mentioned it! |

As Phil said there is no offence of "undertaking". Certainly there is nothing wrong with using a slip road, or a lane set aside for traffic leaving the motorway to pass traffic that is staying on the main carriageway, but common sense says you will use some caution in case they decide they to want to take the exit and move across. Just make sure you closing speed isn't to high, and avoid doing it in the first few yards of the slip in case they are a bit slow off the mark.

if lane 1 is a filter lane and therefore the white dividing lines change its fine to undertake - i always do and have done to a cop car once and no problems with it. As for just 3 lanes of traffic on a motorway and lane 1 moving quicker personally i would undertake there as well

I'm always undertaking idiots that middle lane hog, even did it to a copper before, he looked at me like I'd just taken his daughters virginity but he didn't do f all else!!
