If you give me a few choice details I could always see if he was known to the Social Services in his Local Authority. He might have lots of things wrong with him that should have stopped him from driving long ago.

Not that I should be able to do that. Completely wrong. Makes a mockery of the Data Protection Act. Etc etc...

Think you need a different solicitor. I got knocked off my bandit last year which was written off. I replaced the bike straight awy by claiming on my own insurance. I had to pay the excess but was back on the road. My accident was in November 06 and I am STILL waiting to be compensated for my injuries, damged kit and recovery of my excess. Insurance companies and solicitor all stink!!!
I have been informed that once it is all settled I will get the full value of all my kit as like you sarah it was less than 4 months old. What really gets up my nose is the fact that the bloke that hit me was clearly in the wrong, admitted in front of a copper but his insurance company are refusing to accept liability!! AND my insurance has gone up because I have an unsettled claim!! BMW M3' hate em yuk yuk yuk!!!

When i had a collision with an OAP i went thru http://www.helphire.co.uk/index.htm

I cannot reccomend them enough, They will fight your corner all the way and the claim will be ever so quick as everyday you have thier hire bike thier bill get bigger. give them a call.
Oh and all losses should be reimbursed. i had loads of claim forms shoved under my nose, lol

Loss of earnings, uninsured losses, personal goods, injury, claim back excess etc

Forgot to mention, only works in a non fault accident.

Are you 100% sure that is the rule? I wear contacts, formerly glasses, I don't remember ever declaring it. Looking at the DVLA web site I can't find an awful lot of information - this is about the best http://www.direct.gov.uk/en/Motoring...ide/DG_4022529

It does mention having to tell the DVLA you had corrective surgery, not sure whether that implies you also have to mention glasses/contacts.

Basically, I thought the rule was that if you had to wear them to pass the eyesight test part of the exam, you are legally obliged to wear them whilst driving. But you don't need to specifically declare it.

Sarah; ask your local hein gericke to do you an insurance quote for ALL your kit, we do them for customers and weve never heard of someone being told they cant claim for their kit at what it cost new.

It's always been knowledge to me that if you have to wear glasses/contacts for driving, then you have to inform DVLA.

However, my dad was a PCV driver, so maybe it only applies to PCV/LGV/HGV type vehicles? I don't wear specs or contacts either...

You don't have to tell them if you wear glasses or not, but if you have to wear glasses/contact lenses to pass the test then you have to wear them when driving.

As far as kit goes, the helmet has to be replaced brand new and the insurance can't quibble with that, its a safety thing. You are unlikely to be able to claim the whole amount back for your gear, they quote 'wear and tear' which can be about 15%.

I went back to the shop where I bought my gear and they printed out a statement of the gear and what they are worth and I submitted that with the receipts.

Tbh, your solicitor sounds like s/he doesn't have a clue. Sorting this stuff out for bikers is very different to car drivers!

It can also take time unfortunately. In my accident where it was 100% the other person's fault (he was asleep at the wheel when he hit me) it took about 3 weeks for payment for the bike but almost a year for the personal injury claim which included the compensation for the bike gear too.

According to your document you do not need to notify them:

The law requires that a licence holder or applicant is considered as suffering a prescribed disability if unable to meet the eyesight requirements, ie to read in good light (with the aid of glasses or contact lenses if worn) a registration mark fixed at a distance of 20 meters
So unless I read that incorrectly, you don't have to tell them if you require contacts or glasses as long as if you needed them when passing your test, you have to wear them when driving.

I tried claiming for bike gear on house insurance and they wouldnt pay up. They stated that it is not normal clothing and it is bike related. They said that I wouldnt wear the helmet in the pub therefore it isnt "normal clothing" and is a bike accessory

I only tried to claim cos I dropped my lid on the corner of a kerb.....
