Yeah - I am almost kicking myself as I gave him the cheque for the lessons the morning it happened - I did think about cancelling the cheque, but again (or stupidly) thought I would give him the benefit of the doubt...you live and learn!

You need to remember he's protecting his ass...whilst shafting yours at the same time imho.

Okay he's done you a favour in the past. But he still owes you.

Small claims court? That's why it was invented...for small claims!! Seems harsh but does exactly what it says on the tin.

My experience was I bought a dodgy motor via HP from a garage. By dodgy, I mean it had lots of problems that manifested themselves about a fortnight after I'd bought the vehicle. Weeks went by - the garage were unable to fix the problems ,I was tied to a an HP agreement...but technically the car belonged to the HP company because they front up the money to the dealer. So...I let the HP know about the state of the motor...they were pretty much "yeah, whatever...".

Then I got a form for small claims and read it....thoroughly. I wrote two or three letters demanding that they take the car back and reimburse the money...the last letter said "...or else I'll go to the small claims court".

Firstly they did nothing - even though I had a report from the police about the state of the car. I allowed the time to elapse as stated in the letter. The next day, I delivered by hand another letter stating that in two days time I would be posting my application to the small claims court. The next day, a gentleman arrived for the HP company, took sh!te motor away and gave me cheque for about two grand. I kiddest thee not.

Sometimes, you've just got to do it on point of principle because it's the right thing to do. Write letters. State cut off dates. Explain what you want.

Go to the library and get yourself the book "The Which guide to writing letters". It's the dogs kahoonas!!


Incidentally, the owner of the car dealership did a runner abroad...his business was collapsing - so he cleaned out the safe and naffed orf. He was such a nice friendly chap on the forecourt though when he was trying to get my business...tea & biscuits and everything.

Sounds like he owes you a new lid to me, but that said if it was going home time and he was packing the bikes up...why didn't you move it? I personally wouldn't put my lid by the tyres of someone elses bike...as its possible that they will move the bike/ride off before you!

I have a mate who is an instructor and he likes to secure the bikes ASAP, so he can go home earlier.

Long story short, although you are partially to blame, he probably does owe you a helmet or it least a % of the costs.

How do you work out I am partially to blame? I wasnt aware he was going to put the bike away as my girlfriend had just arrived to pick me up - whilst I was waiting for her to get out the car, the next thing I hear is the engine start and the crunch of helmet on bashplate...
All I did is what he asked - i.e. put the helmet on the ground after being told not to put it on the seat. The helmet was to the left side of the front wheel, so anyone could see it as you approach the bike from the left (but not him, obviously).
Still not sure how when the lid was only 5 days old, and he caused the damage, how I should only be entitled to a percentage of the costs....?

maybe you should not of put the lid so close to the wheel?

i tried to move my bike backwards a while back, & it would not move, i thought it could be in gear, until some idiot had a go at me for trying to run over his helmet, he put it about an inch behind my bike.

i think you need to keep on at the instructor.

Yeah, fair point - I thought around 6 inches to the side of the wheel was out of the way enough tho - nevermind - sorry didnt want to appear arsy, appreciate all of your comments on here.

It's a traffic accident FFS.
If you've passed now & don't need him for anything just report it to either your insurance or Police (your choice) and name him as the Third Party that damaged your stuff while he was riding.

I understand how you feel - but its not as though this guys your neighbour and you have to live next door to him. Put it like this, if you had caused the damage and the boot was on the other foot YOU'D have been in court by now and it would have been sorted !
