Aye so people tend to understand that in the house under these circumstances people are stressed, angry and afraid, all strong primal emotions that make you want to either run or kill...yet for some reason we are supposed to belive there is a magic wall outside our front door that dissipates that?

Sorry just because they chased him off and didn't get on top of him until he was out the door doesn't change the fact that until a moment ago the roles were reversed and they are in a hell of a state.

It makes me want to go break into the judges house and hold that family at knife point, just to see how they like it.
Being robbed really changes your attitude to this sort of stuff, the key point for me being that suddenly your home is no longer safe, and as such, chasing the guy out of your house isn't making your space safe...it's still a dangerous place because of HIM, he's the danger, that's all you'll see, I promise you that, and that's how he acted, and it's not suppirsing in the least to anyone except the law it seems.

Just because the Judge passed sentence doesn't mean he agrees with it. They have rules to follow when it comes to these kinds of things. At the end of the day, the Judge in question didn't make the law.

Now that is rubbish and as a copper you know it. Sentencing guidelines are just that. Judges have huge amounts of leeway when sentencing. There is no doubt in my mind that the judge absolutely agrees with the sentence. Coppers and judges often view 'taking the law into your own hands' far more seriously than the crime you are defending yourself against. How many times have serious crims got a slap on the wrist because the pre-sentence report says 'poor Tommy got a raw deal as a kid, give him yet another chance'? The sentence is ******** IMO, even if if he was found guilty (or did he plead, have not seen that info) the judge could have given him anything from an absolute discharge to custodial sentence. The judge chose to put this guy and his brother away, because they did what judges are scared to do, punish criminals.

Now that your rant is over:

At no point did I say I thought the sentencing was fair. I have never passed judgement on that.

Certainly up here, Sheriffs have rules to follow. In a kind of case like this it would have been either a High Court case or Sheriff and Jury, either way, a jury would have decided whether or not the man was guilty the Sheriff or Judge would then pass sentence, based on a set of rules AND guidelines they have.

All I was saying is that the judge was doing his job, no need to start the whole "Lets go and rob him and see how he likes it" nonsense as that kind of comment isn't particularly constructive.

Well.Thinking hard about this and relating back to one or two other threads we have had like using a mobile phone in a traffic jam and seriously exceeding certain speed limits I think the judge seems to have got it right.The law is the law and this bloke broke it by beating up the poor scumbag criminal.(Sorry that should read victim)
Now he needs to man up and take his punishment.

Don't think it was intended that way at all.

I read it as more of a - "Would he be able to view the event with the same calm rationality if placed in a silimar situation"
