This could technically be an offence since the highway code states something like 'appropriate footwear'. No footwear would be considered inappropriate I would imagine.

Gave me a giggle, but wouldnt that be a highway code "should" not a highway code "must"?

From the horses mouth.......

If found to have consumed alcohol and driving or in control of a motor vehicle = breath test at the roadside. Fail the test or fail to provide =arrest and free taxi to police station.
At the station, provide two samples of breath, the lower reading is used in evidence.
Fail to provide for no good reason (too pished or "taking the mick") = 12 month ban. If for medical reasons you can't blow at the station (asthma), then EITHER blood or urine test. These are analysed by the forensic science service and usually take about 5 to 6 weeks to arrive. Yes the driver can continue to drive in the meantime, only a court can ban a driver.
