The crown prosecution service would never run with a without due care case if there is not a realistic prospect of a conviction. Without due care has to be driving that falls below the standard expected of a reasonable and competant driver. Section 3 of the Road Traffic Act 1988 makes it an offence to be guilty of what is generally termed ‘careless driving’. However, the section in fact envisages two quite distinct situations from which an offence can arise. First, it is an offence to drive a vehicle on a road without due care and attention1. And if it's a reportable accident, which this doesn't seem like it is, then you have 24 hours to report it to the police.

Huh?

Sounds impressively complicated

Nice one for doing the right thing, I would hate to think of my bike getting knocked over......would be very angry

Spoke to the securty guard this morning - he came over to me when I was locking my bike up. He said that it was a car not a lorry & that the lady driver appeared to be drunk. How you could prove this I don't know!

Bumped into the bloke whose bike it was, also. Say's he's going to report it to the police. Apart from all the scuff marks on his bike there's no other damage.

I think it IS a matter for the police. They have caused damage and walked away. In my book that is a crime.

My car got drove into a while ago and the driver drove away. My nephew saw it happen and I called the police. They came straight away.

I offered this information not on what a mate of mine told me down the pub, not what I read on another forum and not on what I just though was probable in my own estimation. I offered the information from direct experience. A car hit mine causing a huge dent in the door and wing and drove off. I called the police and they came round instantly.

Ho hum, maybe they were just bored that day twiddling their thumbs down the local nick and thought "ah sod it, we'll go anyway, it might be laugh".

Sorry, being pedantic now. But please do understand what the "other" post was about, before using it in another thread.

Didn't you say earlier that it was classed as a "non reportable accident"?
