Charging for goods you didn't order Sometimes a trader tries to charge people for goods that they haven't actually ordered. This is against the law. It could happen when a trader sends you an advert for goods and includes a document that looks like an invoice, to give you the impression that you've already ordered the goods and now must pay up. It can also happen when you’re sent goods you didn't order and the trader demands immediate payment or the return of the goods. If this happens to you, you should report the trader to Consumer Direct – see under the heading Further help for contact details. You shouldn't pay the trader anything. However, this is one of those grey areas, the law seems to refer to unsolicited goods, ie, stuff you didn't order from a company you had no intent to trade with. This thread from the consumer action group forum talks the problem through. I'm not 100% about the law, it's not really in my field, but I wouldn't be keeping the bike, no matter what.

A few years back I bought a Play station 1 game from WH Smiths and they gave me two discs I sold the spare one. I talked to my uncle who's a solicotr and he told me that the second copy was legally mine as I had paid for what i had been given or something like that. I was about 6 so i cant really remember but that was the general jist of what i was told I think

from the dim and distant recesses of my mind. If a company sends you unsolicited goods (book companies used to do this) then expect payment you are they must arrange collection at your convenience or you can keep them free gratis.
However if you ordered something and the wrong item arrives you must inform the company and allow them to collect the wrong item and replace with the correct one or provide you with a refund or compensation. If you had ordered the bike and recieved the lock would you have kept it and kept quiet?? Not contacting them and keeping it would technically be theft i think. Just like if you find a wallet in the street and keep it it is theft, you must make reasonable efforts to return it to its owner, ie hand in to police station. If the police turned up at your door asking about said bike what argument would you use to justify keeping it? or morallly how would you justify keeping it to your child / neice, nephew? just playing devils advocate here. |

It's tempting to keep it, but I would have an overwhelming sense that karma was waiting to pounce if I did.
I have no idea what the law says on the matter, however the fact that you've bothered to post suggests that deep down you know what the right thing to do is. Bicycle - £500 Integrity - priceless
