I recall a concept in law (that seems to have vanished entirely) whereby once you decided to break the law, hence having no respect for the law, you also lost any protection under law during your criminal act.

Surely thats the most sensible way forward?
Naaaaa, the way things work now, chase the little sh*t(s) down in a car, run them over and drive home, if the police do turn up, you were too 'traumatised' to report it.

£200 fine and 3 points if they were on bikes or £2000 and 6 points if not LOL

To get back to original post
Two guys broke into my mates house once, they walked into the front room, me and him sat there, we looked at them picked the first guy up and straight out the window, yes we broke a window, the second guy did a runner, the first guy got up to run off and my mate pulled out his 9mm, and said move and you see lead, for some reason he didnt want to move, the police turn take the gun off him and almost fall over laughing they see its only a replica with the barrel full of lead and cant be used the guy had to pay for the window he used to exit the house.

If that isn't too much force why is this guy getting a jail sentence for punching a guy a couple of times

I was saying that all day yesterday. Indeed.

If the crim "Suffered enough" by being beaten and escaped jail, how then does that measure up to the suffering of the father seeing his family tied up and threatened in their own home which will now never feel safe again?

How does that justify leaving that family without their father for 2 years living in constant fear that the crim and his mates are out on the street and can come back anytime only this time the father isn't there to chase them off....

I just hope the guy appeals or gets let out VERY early.

Though as extreme as I may come across I agree you can't expect the law to allow you to be seen to get away with too much, hopefully they will make this "example" on paper then quietly release him shortly on appeal or just because.
The trick seems to be giving the police and the law a way to save face (IE Drag the guy back to your house and beat him up there...ironically this requires more pre-meditation and is less defensable than "I was in a blind rage and wanted to kill the SOAB!" but more likely to get you off...go figure!

Just like Tony Martin would have got away with it if he had fired a shot into his ceiling (either before or after he shot the guy) and claimed he fired a warning shot and in the dark it looked like they were still coming at him so he feared for his life...instead of rubbing it in the cops faces that he shot him in the back and was proud of it *sigh*

I've lost the link, but I read another article on it this morning which stated that if Hussain goes to jail, the 10 or so people he employs (selling soundproofing material) will be left without jobs.

Lots of good stuff to appeal on!

HAH the guy runs a soundproofing company?
I imagine he's going to be building a handy sound proof room in his house to use instead of the street if this ever happens again!

But in your own home you've ample time for preparing things so they could have all manner of connotations. "beyond reasonable doubt" and all that (though it seems the central govt. wish to ignore this). I for example keep a Ka-bar next to my bed, in case any of my supper gets stuck in my teeth.

I'd say they were fairly justified in a moral sense, if not legally.

I reckon they said the wrong thing in their statements, worth a try that "we were attempting to make a citizens arrest of this dangerous criminal, he reached into his pocket as if for some weapon, so fearing for my life...."

+1 the only casualty here is the public image of the law.

The sort of thing which breaks into houses is an uncivilised animal which only understands violence. The occasional story of a citizen giving one some manner of education in the finer points of property law with a bat would be a great deterrent.

here we agree, but we were talking about law. And the law has to uphold the law - ie you can't have punishment without prior judgement, and this has to be impartial, and breaches of this process must also be punished.

Morally, if you threaten any man's family, you should expect to end up dead within about 30 secs, imho.
