Ebay / Paypal question

When something is bought on ebay, and paid through paypal, is it the responsibility of the seller for it to be posted, or for it to arrive?

Picture the scene.

Something is sold. Seller offers special delivery with insurance, or first class without insurance.

Buyer choses first class.

Seller posts first class and retains proof of postage.

Buyer claims item does not arrive, but has no proof as its not tracked.

Who is now liable, buyer or seller?

It's no longer the seller's problem IMHO. They can prove they posted it, so it's the Post Office's problem now.

Sorry mate but I agree . If the seller has posted it they have lived up to there part of the contract . As they have proof of posting it now all down to you and the courrier . Tough break !

If you paid through paypal you may be elligible for upto £500 insurance although there are conditions . Maybe worth a lokk .

Lets face it, if there is proof of postage it isn't really the sellers fault is it

How long has the item been AWOL??? ... I think you need to give 2 weeks even for 1st class, only then can you count it as missing.

Was the item worth more than £32? (its 100times 1st class stamp ... think a stamp is 32p? these days??), that can be claimed back.

I read the first part of the thread as Miles being the poster/seller...could be wrong tho'..

I tried to post impartially to get a fair response.

I am the seller.

I sold a phone, £49 inc postage.

The buyer said it didn't arrive, I told him its been posted, that I can send him the proof of postage so he claim the £32.

He opened a dispute on paypal, saying he believes that I posted it but it hasn't arrived.

I reply saying I have proof of postage and uploaded an image of the proof of postage, offering to refund the £32 once my claim with RM is resolved, or he can claim with the receipt that I'll send him.

Paypal have just decided in his favour and I have to refund him the whole £49! WTF! Odds are the phone has actually arrived, but me nor RM can prove it.

Tough break, but hey, don't lose too much sleep over ~£20 hey ... it's annoying, but not the end of the world.

I have lost £many on postage when I have had to return items to the seller as they arrive and are piles of junk ... ~£20 is easily lost in that way if it is a weighty item. It sux, but all part of the remote selling game I am afraid!! ... I always get annoyed, but then just chalk it up else you get bitter!!

Gadzooks!! I was right....however...that result clearly stinks. Is there a right of appeal?

What happened to Caveat Emptor?

Paypal 99% of the time work in the buyers favour. Did you have a return address on it just in case?
