cage accident- timescales for being resolved?

back in may i had an accident in the car: me driving along the road in my lane, old dear pulls round a parked car, into my lane, drivers head lamp to drivers headlamp impact. my car written off, dunno about hers.

anyway, this was back in may, i got a courtesy car for a few weeks, then got a new car when they took the courtesy car off me. so in the meantime i have to insure my new car, because i have a claim outstanding my insurer has reduced my NCB in half.

so i've got a claim in for personal belonging damaged in the accident, and for my excess back etc.... now at the beging of august a cheque arrived for my excess, from the other drivers insurance company. i call them, ask what its for as its basically a cheque in an envelope, they tell me its for my excess as they have admitted liability. cool, cash the cheque, phone my insurer and ask them to re-instate my NCB on my new policy. they then say that the other party have not admitted liability the cheque was sent in error or some other crap.

i'm now in November, no further forward, i phone my lawyer every couple of weeks to see if its got any further forward. but nothing. i managed to get them to apply for the bloody police report last month, but they tell me still dont have it yet (i was told by the police months ago this was prepared!)

so the question is from the org legal eagles, what can i do? i just want it sorted as its dragging on and on. is there anything i can do to speed this up, or am i looking at a long wait for any sort of settlement. i'm worried that my insurance company are going to just say, lets settle 50/50 and get it settled.

From what you state, you arn't liable in the slightest. Before accepting any money, you should discuss it with your solicitors or insurers.

I understand some claim disputes can go on for years and years apparently i was really lucky with mine, resolved in 7 weeks

yeah i know, i didnt think she had any sort of case, i wasnt speeding, i was in my lane, she crossed into my lane to pass a parked car, the police at the scene said i would be fine there certainly wouldnt be any prosecution etc....

but i'm just might pee'd off its only now 4/5months after the incident my blinkin insurance company/lawyer are now bothering about police reports and witness statements etc... and only then because i have asked them!!!

Welcome to insurance...

It's a business, the sole aim is to maximise profits, not care for customers

When an unsecured barrier was blown from some roadworks into my car liability was immediately accepted by the contractor, it took twelve months before everything was settled

If dotty doris is disputing liability I'd wager you'll probably end up claiming it from her estate rather than from her, especially if she carries on driving like that...

I've got a claim from March when a tractor was over the line and scrapped down the side of my car. I had to pay a £600 excess. They say that it will probably be a 50/50 split blame which totally baffles me. It still hasn't been resolved though.

You just have to keep phoning your insurance company and keep moaning at them. Although even that doesn't seem to do much. I've kind of given up now and I'm just letting them get on with it

Unfortunatley you may be in for a long wait, a coach went into the back of me and wrote my car off, the driver went to the cops himself and he accepted liability straight away, sorted you would have thought, or not, it still took my lazy ass solicitor nearly 2 years to get a cheque to me and settle my case!!!

Is your solicitor from the legal protection scheme you got with your insurance or someone you hired? The policy ones will simply put you in a queue and will be dealt with by overloaded juniors as they don't get paid much for your case (probably a fixed fee). Hiring your own solicitor may get you a result quicker, as well as proper compensation for the irritation.

im in the same boat...non fault accident in may this year, we was forced off the road by a speeding car overtaking on a blind bend!!!!...4 witnesses after he did a run'.....6 months later..and ive had nothing, bike was wrote off..but still nothing and he's now denying been there even tho there was 4 witnesses at scene, ive had ongoing problems health wise as i had to have knee surgery from the accident, and to top all that last week we had to do an identity parade to pick the guy out and yes he's changed his apperance totally!!!...so god only knows whats gonna happen now...bike alone im £5k outta pocket
