Default Crashed October 31st 2006 - Clapham High Street

Got my black sv650s k5 3-4 weeks ago.
Some tw*tin Clapham High Street yesterday morning took me out.

What happened?
I was filtering down the traffic, and drew level with a black golf, level at the drivers window, when he swerves to his right and takes me out. I didn't have a chance and couldn't believe he did it. It was like he waited for me to get level so he could let me.
From what the driver told me, he saw a van trying to squeeze up the inside of him so it could turn left. He tried to make room for the van so he turned to his right, and hit me.

From my point of view, thats his fault. Single lane road (Clapham high street), driver swerves right without looking and decks me because he is concentrating on the van on his inside.

Here's the catch:
Van driver doesn't stop - typical I guess. Driver of car tells me why this happened. I hope he relays this to his insurance company and to the police who took his statement.
No witnesses as when the accident happened and I sprang up, nobody came over and when I started asking people if they saw what happened, nobody wanted to know; thanks people.
There were cars coming the other way and luckily one was an ambulance.

They checked me over and some parking attendants phoned for the police. Got checked over by another ambulance as well and deemed to be ok.

Damage to Me:
Brusing up left arm and thum where the car hit me and my thumb got traped between the bar and tank. Nothing broken and I appreciate it could be a lot worse.

Damage to Bike
My 05 sv650s k5 is fully faired with the Suzuki crash bungs.
Scratches to the left of the bikes fairing where the car hit me. Clutch lever bracket whacked round and after straightening it myself it seems to work but the position just doesn't seem right. Clutch lever touches the grip when pulled in and I can't remember if it did this before.
RHS of bike has a snapped mirror. Scratches and scrapes to fairing and exhaust.
Rear brake lever bent.
The crash bung took a good grinding and saved a lot of serious damage.
Front motrax LED indicators and R&G tail tidy indicators ok! No smashed glass.

My View
The SV was bought as my commuter bike and I am fully comp. New mirror and I reckon I can use it again.
I don't want to lose my no claims and I hope the other party sticks to the story of what actually happened. The insurance company have offered me a courtesy bike and said they will send someone round to assess the bike and arrange repairs.
I only want the bike fully restored if the other party admits liability and my no claims is untouched. I can live with a few scratches and scrapes and rather not claim for that myself but if the other party is paying I want it sorted.

I am a AA member and they recovered the bike back to my house. Today they phoned to say they are happy with my version of events and will provide me a courtesy bike, the cost of which they will hope to claim back. If they can't claim it back, due to the other party refusing liability, they will bear the cost; basically costs me nothing. Call me cynical, but sounds too good to be true!

I refused a courtesy bike from the insurance company because I want to know that I ain't paying for it!

Has anyone had experience of how to deal with sh*t like this? Any advice/help will be much appreciated.

Glad your not too injured.

Being hit while filtering it a difficult one. It has happened three times to me, twice actually going to insurance (the other one was a company car and the company just paid for the bits and for their fitting with no argument) I won one and lost the other.

I pretty much recon his insurance company won't just accept liability so deciding who is at fault my take a little while with no witnesses. The AA thing does sound rather good, make sure you get a contact (or whatever) saying they won't chase you for costs.

Sounds like my accident. The other insurance company are saying that the driver moved out to avoid an obstruction and that I hit the car. They are disputing the claim!

Talk to your insurance co and get some solicitors.

In my case with the company car we decided on what the damage was and agreed that was all there would be but the bike was still ridable and I wasn't actually knocked off.

A colleague had a courtesy car provided by the AA when his car was off the road (third party to blame) and the rules and restrictions were very tight, examination for damage on return was like a police forensic search of the vehicle for evidence

Dude, sorry to hear this - what time was it. I was in the area at about 6.15pm (had a *mishap* myself at Oval further up the A3....another Jaguar *sigh*, *ouch*).

Whereabouts were you? Traveling northbound, yup it's a single lane road..Southbound however it is wide enough for two lanes of traffic (unless you're right outside Infiniti at Clapham North...)
