Mate,

Gather your evidence, put it into writing, citing other dealers and owners that you might have had contact with.

Perhaps talk to a Solicitor too - Sythree might be able to help.

Send the letter, along with the keys and registration document, recorded delivery, back to the dealer rejecting the vehicle under the Sale of Goods Act, as unfit for sale.

This should ask for your money back, including costs, though perhaps you should expect a "reasonable" deduction for age/mileage of the machine.


KTM's are quite fun, but I review them with suspicion after they didn't give Charley and Ewan a bike last year - simply they would have slagged off the machines at every opportunity.

not sure i'd agree, i've a ktm which has been hammered (off road) and ather than crash damage its been fine. i do think cloggsie has a rogue one which is made worse by an incompetant dealer. however, stick to your guns and get your money back!

Either Trading Standards service for FREE or the sight of a solicitors letter on their door step might get them moving & make them see you are not going to be fobbed off. If the boot was on the other foot, you'd have probably had a court summons by now.

Clive, A friend bought an sm around the time you bought yours, he's a VERY picky customer when it comes to his bikes and has had no probs with his.

In the past, If he has had any trouble with bikes they get binned very quickly. He is so pleased with his sm, he's on the verge of getting rid of his bmw 1200gs for a ktm adventure as his second bike.

Still resonates?? Did it before the incident in mid November? Sounds like a load of BS to me and they´re trying to evade responsibility. Will PM.

I will speak to my local KTM dealer when they reopen after Christmas- I bought my SV from him and he did all the servicing for me. I should get a straight answer from him.
