Don't know about the legal details, but in the letter dated 23rd July 2009 the part labelled in red that they seem to be basing their entire argument on doesn't mean anything like what they're saying it does...

I wouldn't advocate anyone withholding their Council Tax on the basis of this one case. This case does not set legal precident.

There are thousands of liability orders issued up and down the land each year and people have gone to jail for none payment.

On the other hand, if someone on here wanted to try it I'm sure we'd all offer moral support ;-)

I would gladly pay his council tax, it is less than half of mine. He doesn't know when he is well off.

Someone has got to empty my bins etc, and I accept these are services I have to pay for. Whether I get value for money or not...

"Cheaper not to litigate" is probably OK in the case of an individual but what happens if a couple of hundred try this? Surely that would set a legal precedent.
I can't work out if he refused to pay his council tax or refused to accept the legality of the system by which it was being claimed.
I think it is the second e-mail where he offers to pay.

thats what I was thinking, if this ever reached a stage where many people tried the same thing then the council/government would be all over it.
