Default consumer law - advice required please.....

Hi All

Situation is as folllows....... I made an order for some products from a company's website and have been waiting over a week for dispatch of my order. I got in touch with them this morning, and apparently they are awaiting delivery of some of the items still. OK, not great, but I can wait. HOWEVER, they have debited my account in full, last week when the order was made.

My question is, is this legal for them to do so? I was under the impression that they cannot debit an account until the order is ready for dispatch (i.e. they have all products in stock). Does anybody know anything about this? any web links to use as a reference? And what can I do??

Any help/advice/guidacne would be much apprecieated....

As soon as the order has been processed and confirmed then they are able to I believe. As long as within effect of PR as far as I'm aware that your notified that all products are in stock, then they will ship them too you.


The area of business I'm in doesn't look at that however so cannot really foot great advice, but as long as all arrives safely and as you expected its all good!

Think they're within their rights to take payment when the order is received. If a delivery period hasnt been agreed the supplier has to deliver within 30 days of the order to comply with the Distance Selling Regulations. If this is not met, a new delivery timescale has to be agreed or all monies refunded.
