Default Consumer Rights on Motorbikes

Does anyone know how I legally stand on this issue,

Basically I bought a SV650s 99 v Reg in November 2005 in the last 4 months it has broken down and been taken to the garage I bought it from 8 times. I am now at breaking point as I use the bike to commute to work and now feel that it is too unreliable to ride.

Ideally I'd want them to buy it back from me at the price I originally paid however I guess this is unlikely.

Has any one been through this sort of problem or know anyone who can give me advice.

Just out of interest, what sort of mileage have you put on it/was it when you bought it? Has it been serviced since you bought it in accordance with Suzuki's service schedule?

It had 10.5K and is now on 13K.

In your shoes, I would be making similar requests but I have no idea of the legal standings!
Intermittant faults can be hugely frustrating for you and the shop who probably bought the bike in good faith. A similar fault on a friend's bike turned out to be a dodgy wiring loom that took ages to track down. Best of luck sorting this out!

Sale of Goods Act - fit for purpose would probably cover it. Applies to second hand bikes bought from a dealer as much as a new one IIRC.

Theres a link on the DTI site, google sale of goods act and it should find it.

Speak to your dealer first - try and get them to do the work voluntarily. Did they cover it with a warranty btw? Got mine with a years warranty from Bats which they honoured when they had to replace the rectifier.

Failing that, speak to trading standards about the above. Im sure that a bike thats off the road for that length of time in 4 months fails the fit for purpose bit.

the First problem was a hole in the tank. then the carb heaters wouldnt come on hence it kept stopping when I rode in the evening, however this persisted, even when the heaters were fixed, then the hose that allows air into the tank was kinked. Basically it keeps having problems that if the company who sold the bike to me bothered to do a full check of the bike might have easily have found the causes and saved me alot of time and money. I'm obviously trying to learn how to check for problems but with no real experience I have to rely on the shop mechanic. I've now got to the point where I cant afford to miss any more work, if the bike breaks down and needs to go in for repairs.

In fairness to the company I bought it from they have picked my bike up and done the repairs for free, but they seem to assume that there can only be one thing wrong at a time hence they fix the obvious problem but dont check for any under lying problems
