If it is her fault then you should not have to pay the excess. The excess applies to claims made on your insurance policy, surely you will be claiming against her insurance? (that claim being handled by your insurance on your behalf.)

Your excess will be taken until the cliam is proved non-fault, uyou can then use your legal cover to re-claim this and and damaged kit, injuries etc,

Indeed, but as she hasn't admitted liability yet I've been told that technically it's a claim on my policy and then the costs are recouped by my insurers from her insurance company if I'm found 100% not at fault. I think that this is how claims usually work, but I'm happy to be corrected on this

The bugger is that this could drag on for 3 months and I'd be out of pocket until the whole thing is sorted. Hopefully being fully comp will pay for itself on this occasion.

See above hun (but yes thats right, you lose your ncb-unless its protected and you pay out the excess-all that will be re-instated if they claim is proved to be non-fault)-be warned it can take awhile (years even), im lucky mine took a few months but my pa claim is still pending
