Default Unencrypted modems - beware

I'm acting for a client who received a letter out of the blue from a law firm in London. They act for a film company that owns the copyright in a porn flick, I won't post the name as it wouldn't pass the U rating!! He had an unencrypted modem thingy...

Film company has traced that his equipment was used to make the film available on the net through a torrent and is demanding damages for breach of copyright and costs. My bloke is adamant that he has never accessed porn on the net, and he was very upset about it all. Turns out he lives in an apartment development in a densely populated area, the sort of place where people come and go all the time, and this is alleged to have happened last April so no chance of finding who did it.

Poor bloke was so embarrassed

Are they saying he created the original torrent? Or have they attempted proceedings on everybody to ever seed (send out to other peers after downloading) the file?

Probably didnt upload it to bitorrent.......but if he lies in court and say he has never looked at the stuff then he is only damaging his reputation further making him look more guilty lol

the name of the law firm is davenport lyons?

they're well known for simply sending out tens of thousands of demands for money, and now they seem to be trying to use the social stigma of the type of media downloaded to get people to pay up before they go public, otherwise known as extortion

So what you saying Ed? That you should somehow encrypt your modem so that these anti-piracy programs cannot trace you? Or is your client aledging that someone hi-jacked his internet connection because his wireless network was not secured?

even encrypted wireless connections can be quite easily broken into. You only need a few readily available tools.

You can access anything a computer has done, anytime, so if its that serious, send his computer off to be investigated.

No matter how many times you delete files, clear things, EVERYTHING you look at has a record kept on your hard drive, and you need a special program to wipe this section (no a format and re-install wont hide it )

So get a forensics team to look at the PC, theres your answer if it was viewed or not.

Can't help who may of actually done it though.

But the important thing, was the said porno any good

Much easier/cheaper to put the onus on the Pron-barons to prove that thet IP address they have was used solely by the guy in question at the time in question.

If its any kind of shared connection then tell them where to shove it
