The big issue with all laws and regulations are that they are open to interpretation and, alas, manipulation (i.e. the guy in MCN who got an ASBO for filtering when the law he was charged with was meant to stop off-road bikers on common land.)

Individual situations can be dealt with as they are, individually, but, these days everything is dealt with in a "blanket law" sort of way. If you are speeding, you speeding, be all and end all. If you caused a crash, you are to blame, be all and end all.

So on and so forth...

agree with that! blanket laws are useless. I would prefer everything to be looked at individually and yer i know this would be very very hard to do with workloads, but its the only way to be fair.

If someone has died it can't be an 'accident.' Even if it is within the speed limits and the driver is deemed to be driving with due care and attention, something had to happen to cause the fatality, an "incident," there by it was not an "accident", but, a "collision," because someone is to blame, even if it is the dead driver...

With the cut backs within the Police force and the further reliance upon computers and camera's I don't see it happening anytime soon or ever.

Besides, with the training the police seem to get these days it takes them 8 hours to reconstruct an RTC when it used to take 1 1/2 hours...

One thing you should never do is attempt to apply common sense to law....The two just dont mix!

Guys dont forget the 'something' that could be to blame eg a tyre blowout, collapsed suspension not necesarily driver error!

CA the reason it takes so long to investigate accident scenes is because serious and fatals are deemed as crime scenes pending conclusion of the investigation. This means they are treated with the same procedures as a murder scene! It ain't no walk in the park!

Wow, this discussion got outta hand pretty quickly I was apparently seen popping wheelies in a residential area and doing 70 in a 30, it was by an off duty officer so was reported and I was issued with a section 59.

Eh...excuse me. That's exactly where police officers are supposed to fit in. They take the law and apply it with some common sense. It's when they try and replace them with machines that it all goes wrong.

Wizurd I do know what you mean. At least I think I do....eg there was no intend to cause injury or damage but due to circumstances something happened.
Its just that on investigations you find that usually,not always, something could have been done to prevent the incident be it driver or vehicle maintence. It doesn't mean necesarily that blame will be applied to any party but it will show a full investigation for any relevant family. Remember the Police are accountable to them as well.

Your excused. Just playing! Thats exactly the role of a police officer! As well as social worker, office jockey, whipping boy...etc....Lol
