Ahh, human nature again. Assumption. Jumping to conclusion.

I didn't say that the farmer could shoot a dog that wasn't next to it's owner or on a leash did I?

I just said that we have to accept from the OP that the dog wasn't under close control as required by law.

I don't know what punishment if any breaking that law entails, but I didn't say it was therefore OK to shoot the dog. It was you who jumped to that conclusion.

notwithstanding the fact that the legal requirement for use of lethal force isn't anything to do with a dog being under any control, and everything to do with using force as a last resort against an animal attacking your livestock........

so, without wanting to jump to any conclusion i'll ask you directly...

would the farmer have been justified shooting the dog in this instance?

if not, why make threats of such unless you're waving your tiny **** around trying to scare or bully someone??

If the farmer would have been justified? I don't know 'cos I wasn't there and don't know anymore about the law than what I need to know as a dog owner, which is why I haven't commented on that all. My guess from what the OP has posted (and common sense which the law doesn't always follow) would be No. If the dog had bolted in the direction of the open gate where the livestock were then my guess would change to Yes.

Why make threats? He shouldn't have done, he was being a tit. But I can understand what caused him to be a tit. If I'm out front gardening and see my dog wander off down the pavement, then I turn and see a car driving down the street, I panic and start shouting at the dog to come back. The dog hasn't yet stepped off the pavement, but I can see that the possibility is there and my anxiety level increases. The OP's dog hadn't worried the livestock, but the farmer could see that possibility and his anxiety level increased too. He just didn't handle that anxiety very well. And we've all lost our calm and shouted things we shouldn't have done from time to time.

This throws quite an interesting light on things...the way I read it your dog wasn't bothering any livestock anyway!
