Oops, Jon, glad you are ok. No idea whose fault it is. If I ever filter past someone who has suddenly left a gap I stop cos I imagine something is going to come out into it. But anyway, the main things is that:

Personally, I'd say you were at fault regardless of what the police or insurance say. It's always a risk when filtering. Especially so when passing a traffic junction. I'd say if you managed to hit, you were going too fast and not being observant enough. You have to think for those that don't. Apart from that, it's not always easy for the person coming out of the side road either. Especially when the traffic is stationary. Their view of you will quite probably be obscured right until the last second. However, very happy you are not reporting anything more serious. |

Sorry to hear about this Jon but so long as you and the bike are OK then thats the main thing. I shouldn't worry too much about the insurance, I would be inclined to blame the car but without seeing everythign I couldn't really say. I had the same thing happen to me after I first passed (on a borrowed bike

i'm with woz on this one...
situation is the same as emerging between parked cars imo, but no idea how the judge may decide get yourself a good legal representative...

Not worried about it and realise that I share blame on this one. I am usually very observant on junctions, but this woman came out of a company driveway that was obscured from my angle by a big sign/wall. She did come out pretty quickly when she was flashed to do so leaving me no room to manouver.
[IAM mode]I didnt read the road (ie see the obscured driveway and gap in car) and adjust speed accordingly.[/IAM mode] Anyhow, dont want to get into the blame game. Independant of whatever anyone says, I share some of the blame and will now adjust my riding accordingly. This could have been a very painful and expensive lesson, so I am counting myself lucky.

Speak to RSS (Rider Support Services) who helped sort out my claim when I was filtering. They didnt let it rest until the woman who hit me accepted liability.
If you use them, mention my name (Colby Sipson) as they like to know where the recommendation came from. You can appoint them as your legal representative even if you have legal cover on your insurance. My insurance provided one immediately wanted to settle 50/50 BTW.... |

Could someone just clarify - if you get a 50:50 claim then you still lose your no claims bonus. Insurance companies therefore have a vested interest in both parties losing the discount?
In addition what is the point in fighting for a 30:70 blame? Does it make your insurance cost less next year...if not why fight for it?

I think both lose no claims for 50:50. I think 70:30 is just to share costs a bit more fairly or whatever. Hard to prove really.
