I've received all your threatening letters and calls. Please keep them coming as it's all good evidence. I believe that your collection costs are unlawful, so you're also wasting your time and money by continuing to hassle me.

I am not intimidated by your threats.

Bennetts owe me money, I don't owe them - or you - anything. I'm not going to pay you a bean. I positively welcome your threats of legal action because I will defend and counterclaim, and I want to see you lose when this goes before the District Judge.

So please get on with it and issue a claim form as soon as you can. In case you didn't know, you can do it on line these days - you don't need to send forms off to the County Court office. As stated, I will defend your claim and I will bring a counterclaim of my own. And my counterclaim will include not just the money that Bennetts owe me, it will include a claim for stress, harrassment, and the time I have spent in trying to resolve the matter.

Althopugh there is no pre-action protocol on this type of claim, in furtherance of the overriding objective I am again enclosing copies of the letters that I have sent exoplaining my position and which you and Bennetts have chosen to ignore.

Incidentally, on issuing my counterclaim, the Money Claims On Line service will transfer the action to my local county court, so you will have to conduct your litigation at my convenience, not yours. You will also have to pay an allocation fee and a hearing fee. And you'll also have to get your evidence in proper order for the Court. I'm telling you this just so you don't get an unwelcome surprise.

So please issue your claim as we need some closure in this matter. The closure will be an order against you and/or Bennetts.

The Court will need my correct address to serve your Claim Form. My correct address is......

I do this for a living... very few cases ever come to Court, usually debt collection agencies drop it as they realise it won't be cost-effective. And when they do, you get some idiot who knows nothing about the case, has no idea about how to present a case, no advocacy skills, no nothing. All because it will cost them irrecoverable spend on a lawyer
