Actually it is a failure, see here:

Thats a offical UK bike mot testers "bible"
It all depends on how strict your mot tester is im afraid, so the guys only doing his job.

If youve only removed ONE footpeg, hes failed you as you still have one on the bike-either remove both footpegs or put pillion seat on for mot

it's got a seat cowl on it isn't intended to carry a pillion

Doesnt matter, footpegs need to be removed complety, same as lights-if they are there but not in use the switched need to be taped over or it would fail (i used to work in a MOT station that did car & bike mot's)

Ever thought that they may have been due a vist from VOSA? ask Matt aka treacle-he's a mot tester and will tell you guys the reality, 99% of the time they dont WANT to fail your car/bike but they dont know if its someone from vosa either doing a spot check or could be waiting down the road to check vechiles coming in/out after theyve been tested-if theyve passed something they shouldnt have then vosa will re-voke their licence to do MOT's
