I voted 'Book-em Danno' simply because I see way too many cagers on their mobiles - they don't care!. Giving a ticking off isn't always a good one, as someone who's given a ticking off may cause some serious damage 'next time around', just because, he/she thinks they'll get away with a telling off again. Just my opinion though. Punishment is the only way to go sometimes. Chin

Yeah- booking. Aren't most accidents caused at slow speed because people concentrate less?

I've gone against the trend and said give him a break. I don't believe in the 'broad-brush' usage of most laws in this country. As long as he was maintaining control of his vehicle, reasonably aware of what was going on around him and leaving a big enough gap in front of him so he cant react, then I don't see the problem.

I'm obvisouly completely against the use of mobile phones at normal driving speeds.

If you mean accidents in general, then I think a TRL report I have somewhere says the majority are on country lanes at higher speeds, but this is probably outdated by a few years now!

Not sure about specifically low speed accidents, but I would hazzard a guess that it is distraction by radio, phone etc when crawling along.

does it really matter if he was paying attention though, it is still illegal, it's like people seem to struggle with any law that is simple these days. IMHO everything while driving should be banned smoking, eating, drinking the lot.

And hopefully he's learned the lesson and won't use one whilst on the move next time - it could be at xxmph and he could've had an accident.

Look on it as an accident avoided.

I won't get in a tit for tat argument and try not to post again, but I'd personally like to be able to use my phone whilst crawling at say 5mph. I know they've done the complete ban for a reason, and that is to eliminate any grey areas, but there isn't much that can go wrong at 5mph if you keep to the centre of your lane, keep a check that no one wants to enter your lane and don't rearend the car in front!

I'm not an expert in law, but is it not the case that people who pull over to use their phone and leave the engine running are still breaking the law?

A hands free kit is less than 30 quid, a wise investment when a ticket costs twice as much.

I say book him.






This comes from somone who got booked for mobile phone useage while driving in Southall by a very nice blonde copper woman
