50:50 yes both will lose their bonus
80:20 you very well might not lose your bonus - depends on individual companies.
What you want is knock for knock i.e. fix yer own.

Anyway, Fully agree with you taking some of the blame as far as avoiding the ame accident in future, but as far as Ins. is concerned I'm with Woz this should not be your fault, another recommendation for RSS to make this so.

Also genuinely , what have you learnt (as per OP)
Could you have been riding further out to the far side of the road? would this have helped?

I think this is a prime example that 90% of the population don't know that bikes CAN filter through traffic legally.

doesn't it depend falc's accident was 50/50 still kept his no claims bonus

I have just spoken to RSS. Alas they cannot do anything for me as I am not actually claiming for anything - my bike and me are both unharmed!

They were extremaly helpful though so definately one to remember for the future!

Oh and their advice was that this was a 50:50 claim. I had slightly more leverage as the car was not emerging from a junction but was instead coming from a driveway.

The other car drivers insurers would however argue that I should have seen the gap in the traffic, and they would be correct!

Legally - but at your own risk!!

In the same way as when you undertake a manouver you are responsible for ensuring that nothing is going to hit you.

Indeed it does - hence the 50:50 nature of the claim!

Both parties are equally responsible for ensuring that they do not cause an accident.

As far as insurance is concerned, that's a bit of dumb statement. How are you supposed to concentrate on progress if you are spending every second watching for anything at all that could appear from the side of the road at any time. Especially when filtering past stationary traffic.

However. Stationary traffic, there's a gap, automatically think it been left for someone to fill it. Automatically expect something to fill it. Stay with those thoughts and you shouldn't find yourself in the same situation again.
