Its not illegal to take the photograph but it is illegal to publish it without permission. Its not something that is often enforced, especially as after the fact you can't unpublish it.

You have a right to photograph but what you do with the photograph is subject to restrictions. The Police do not have a right to stop you taking the photograph, nor do they have the right to ask you to delete the image.

It doesn't take much searching to find that no compensation has been offered or complaint made. The £3.5k was a totally different case/people etc.

the met say they are investigating this one despite there being no complaint. The kid is considering action

The one thing I did note was reading the kids blog how they had to "spend several hours in hospital due to severe and debilitating back pain"

Personally I think the photographer was an obnoxious little squirt who was clearly going out of his to be difficult, that however does not excuse the behavior of the officer who should have known better and risen above it. I've policed loads of demonstrations where you get professional "activists" who know exactly what they can and cannot get away with and set out to deliberately wind up an officer in the hope of getting footage like this. Normally you look out for your less experienced colleagues and make sure they don't get baited, shame there wasn't someone there to look after the inspector..... My verdict, a good example of both professions at their very worst.

this is a point thats crossed my mind every time I watch a programme like Road Wars, often you see people getting agitated by the presence of a TV camera and they are told they have no rights to tell the guy to stop filming them. A number of times the presence of the camera has wound up the person to the point that they have gone on to be arrested for swearing or some other undesirable action.

So its ok to get your pals on TV and to make a programme like that without any regard for the persons preferences but not for some 'obnoxious squirt' to take pictures in a public place?

DP, sorry but I dont agree on the military in public thing. I know its your personal view rather than a right but taking part in a uniformed parade along a street in a public place puts you in a position where you should not be at all surprised to be photographed. If it creates a risk to have military personnel pictured in public then they should never have been there in the first place.

The inspector was raking up excuses to win an argument. The kid may have been a little obnoxious but he had every right to be there in my opinion, good on him for standing his ground.

The photographer wasn't being obnoxious whatsoever regarding the circumstances. He was trying to do his job before being detained for something the police couldn't tell him. Any right-minded person would have been livid.

Yeh, but you also note that the people who are not happy about it get their faces blanked out...

I work with various TV film crews all the time and we go to great lengths to make sure they don't add to the problem, and I'm not disagreeing with you that the officers were out of order. What I am saying is that the photographer clearly did something that made him the focus of attention which he clearly hasn't shared with us, but that doesn't excuse the officers.

All we have is the boys edited audio track and a few chosen images, and have become judge and jury over the incident.
One day he might exercise his right to take pictures of davepreston and the same copper will be called to get the camera out of his a*se
