I've got to agree. Fast cops have killed before:

to find a queue of stationary traffic at roadworks. Twenty seven year 
old nurse, Judith Wood was killed as she sat in her car in the queue, PC 
Sharatt was fined for careless driving.

In 1997, PC Adrian Ward was taking Shelley Simmonite, 15, home to her 
parents after she had been arrested for suspected shoplifting. Driving 
at up to 120mph, he went through a red light and lost control, hitting a 
van. He was estimated to have been travelling at 65-75mph when had 
applied the brakes. Shelley was killed in the crash.

There was always the opportunity for the prosecution to lodge an appeal, which could, of course, result in overturning the original decision. This relies on appealing on the evidence presented in the original case. "Double jeopardy" relates to holding a second trial with new evidence and does not require the first case to be overturned.

Silly copper had the decision overturned as the courts have decided they made a mistake.

I fail to see how anyone could have argued that 159 mph was safe for one driver. On that basis Michael Schumacher should be allowed to break the limit too, then maybe a Formula Ford driver would be allowed to break it a little bit less etc.
Using this argument I could argue that I speed regularly and dont have many accidents, therefore I can drive to a 95 mph speed limit on motorways, but the man down the street has dozens of accidents and should only be allowed to drive at 40 mph!
