Just been through that with my akro system. He said he had to fail it because it had "NOT FOR ROAD USE" stamped on it but the law states that if it has no markings on it the its at the examiners discretion. After a little advice on another thread I took it back and he passed it for me . He did'nt care about the noise, and it is loud.

Yep, just put black tape over the "not for road use" bit , its what i did on mine

Law or not he's being a tit.

IMO MOT testers provide a service to society making sure you're not on a deathtrap, being rsehole jobsworths like this just cause annoyance. Failing it for a knackered tyre, that's a fair one, but that's just taking the pi$$. I'm not even sure he's within the law. I thought it was if you had a seat on it, you need the pegs.

Take the footpeg in, bolt it on there, get the test done, remove again.

I love my mot tester, when I was telling him I had electric problems he said he heard relays went on sv's a lot. Even though I told him I reckon my issue might be sorted now he's got me a spare he had lying around.

Although I have actually never heard of a multifunction relay going on an sv? But meh still nice.

well went back there today and he passed it after i had put the other footpeg on. like someone mentioned i had 1 footpeg on the bike used to hang the exhaust. because of that i should of had 2 passenger footpegs or 1 footpeg and a grabrail. he even said that when i rang to check if i could drop by for the retest. i had to go back there with the new tyre fitted anyway so not really a big deal, would of ****ed me off if the tyres were ok though. he also failed it on the rear reflector on the original test but didn't even mention that when i dropped by so he let that one slide. just glad there was nothing bad wrong with it that would of battered my already battered wallet.

as a tester (car) myself, i can see why he's failed it. some people do the tests by the book, most don't when it comes to little things like this.
99% of the time if its a vosa 'bait' vehicle then it would be meant to pass, or you would see them taking it out of the back of the van round the corner, as it is illegal for them to to drive such a vehicle on a public road!
they may however turn up after a test has been done and check the results by doing an mot on it themselves there and then.
vosa are more interested in catching testing stations making up failures as it gives the industry a bad name if you catch them out.
also it is very unlikely he would lose the right to test for misinterperation of the rules (he hasn't, but if he had). a testing license is like a car license, he just get a few points that are valid for x amount of time. once you have x amount of points you may be considered to be banned/suspended, but only considered, its not automatically like driving.
when i did my testers course the tutor had a catchphrase- 'you are not there to fail vehicles, you are there to pass them!'.
