Eh, no you don't. To get points put on your licence you either surrender it when convicted at court, and they endorse it, or as already explained when given an FPN you surrender it to the police (either at the roadside or at the station) and they then send it to the ticket office who can act for the court and add endorsements.

The only time you can be required to send your licence back to the DVLA for endorsements to be added is when you are convicted in your absence at court. DVLA will receive notification of the conviction and endorsement from the court and they then write to you requiring you to return your licence. If you don't return it, (or the address on your licence is out of date and you don't get the letter) then DVLA will revoke your licence. If you then get caught driving it's a straightforward no driving licence offence. You would be surprised just how many drivers fall foul of this.

Well Mr Herring that makes me a douchy knob as I was unaware that a producer was in effect the surrendering of your license. Hence my afformentioned two footed jump into my douchy knob rant.

That's not lucky. Lucky is pulling away from two sets of lights on the rear wheel, riding on to the motorway and filtering through traffic in treble figures, doing a stoppie on the slip road at the traffic lights and then being pulled over and only being given a fixed penalty and fine for excess speed on a motorway. Policeman who pulled me over was at the first set of traffic lights. Now that is lucky.

Lucky is having a straight through exhaust on full throttle in 6th gear and getting pulled over. For the policeman to have a 'chat' about my undertaking and then letting me off with a comment about how cool the exhaust sounded. Now that is lucky.

Lucky is when you have been practicing your wheelies on what you think is an empty road to land one and see blue lights in your mirrors. Expecting the worst when the policemen say if you can do a better wheelie than the one you just did, we will let you off. Now that is lucky.

I've had my fair share of luck. Paying heavily for my last trek down the motorway on the YZF though.

Swings and roundabouts, some you win, some you don't. Blah blah blah.

Part of me wants to tell him to shuv it..

I clocked you doing 97, but i couldn't confirm the reading so I chased you, you pulled over and out of frustration for not being able to prove in a court of law 97 ill stick you for £60 & 3 points, coz both of us know you were speeding but I cant prove it and you dont want to admit to it..?

Is my cynical side coming out..

Unfortunately not, hence why I asked if the OP was shown the device with the reading displayed. The only exception to this is when the speed is recorded in a follow (done on the police vehicle calibrated speedo) but then they are required to follow you at a constant distance for 2/10ths mile and from the OP it didn't sound as if that happened.

when i said cynical I meant, how i would love to react in that situation, i to would get out my own tube of ky and let him have his way, after all i have sped lots of times and not been caught.

You're right to be cynical, things aren't always done by the book. However it is also fair to say that if you know you were doing wrong and you're been let of lightly for what you know you were doing then there is some comfort in believing you're had a result.

Exactly - I have spoken to a couple of friends today and they have pretty much all said that I was very lucky in some respects and that in the circumstances they would have acted exactly the same way (eaten humble pie and been grateful that no dessert was on the menu)...
