I can see this from two points of view; my own set of beliefs and, obviously, work.
She has gone from commiting simple speeding offences to a "serious" criminal one, for which, she can be sent to prison. That she is a solicitor only makes it worse. The insurance question is one of those that comes up alot in traffic policing and scameras. The ticket office that issues these NIP's do not AFAIK, ask for any proof of insurance. They are only interested in sending, receiving and dealing with the speeding offence. That is why people can pull off this scam. GMP have a unit, staffed by traffic cops who investigate exactly this scam. I am sure every force has a similar one. They act on calls to Crimestoppers, letters, and so on. She risks loosing it all for the sake of a speeding ticket. If she took the points, she would know she could go to court and plead "special reasons" for not being banned (as mentioned before) and continue. Now, she risks loosing he licence, job and future security as she would have a criminal record for a deception offence and would render herself practically un-employabe in her field. I certainly wouldn't want a solicitor with a record working for me, although in some parts of the world, I'm sure she would get more work! Should you shop her? Probably not, as a friend (debatable in my opinion) but a call to crimestoppers is anonymous for anyone else who knows her.

I've just read this whole thread and am totally dumbfounded at the stupidity and lack of respect this person is showing for a) the law and b) you and your family.
I believe that she is no friend at all. Turn the tables around and ask yourself these simple questions: 1. Are you stupid enough not to notice 5 cameras and slow down appropriately? 2. After getting your first 3 points would you not slow down a bit, nobody wants points on their licence? 3. After 6 points..........as above? 4. After 9 points and knowing a ban is not too far away...........as above? 5. Would you even ask your own daughter to take points for you? 6. Would you ask a friends son/daughter to take some points for you? 7. The final question to ask is if you really did all of the above would you still consider yourself a good friend? Would you? Another couple of things that spring to mind are: Did she ask you? and if not why not? Is she paying the additional premiums on both the others insurance for the coming few years? ......and this doesn't take into account the fact that her profession is that of being a Solicitor, but as Neio79 said, you would definitely want her on your side in court and not against you. Can I just ask, are we missing some of the story here. I can't help thinking that we have been given the bits you want us to know but missed some bits out. |

Eeep, hold on there just a cotten picking moment - she's a solicitor? A proper grown up solicitor or a legal exec? I've worked with a lot of solicitors in my time, and sure they can be unlikeable and a teensy bit devious, but there is one thing I really like about them - they tell the truth. All the time. It's basically the only profession where you're guaranteed the truth and it's a massive fundamental tenet of the profession. I'm sure someone will dig out the case, but there are people who have convictions for murder who have remained on the Law Society's books because they didn't decieve, whereas folks who have lied about parking tickets are struck off without a second thought.
It's crucial, in conveyancing for example (and I'm sure again that Ed will elaborate further), if a solicitor says "this money has been received, you can release the keys" then it's taken as truth. No other profession receives such trust over such immense sums of money. Whatever you may think of the legal profession they can always be relied upon to tell the truth. Without that, the entire legal system, civil, criminal, everything, falls down. Basically if she loses her licence and can't meet clients for a while then this will undoubtedly temporarily hurt her career. If she lies then she's lost her entire career. For good. And rightly so. I'd rather have speeding solicitors doing my conveyancing than lying solicitors thank you. If it only involved her I would without question dump her in it. Not a shadow of a doubt. As it involves your daughter, and your daughter is undoubtedly better off with three points than a criminal conviction then no, you can't really. But certainly tell your daughter that if she *ever* so much as mentions it again she should inform the woman in no uncertain terms that she will go to the police and the law society right away. And under no terms do you allow this woman to do your conveyancing, your will, any legal work whatsoever, even if free; and do not recommend anyone you call friend or family to this ex-friend. |

krhall - I see your points but no, I'm not leaving out anything of significance, apart from who she is obviously! The 'youngsters' involved are both over 21 so why should she ask me?
Yes, she is a fully qualified, paid up whatever solicitor, but she doesn't do defense type of work.

Also have you said anything to your daughter about it? Has she said anything to you about it?
What does the lady (?) in question have to say about it all, I'm sure you have expressed your feelings over it so what does she have to say, especially about the giving out points illegally? |

If your daughter needs to insure her own car any time in the next five years, then those points are going to significantly increase your daughters insurance premiums. Possibly by around ?100 per year. Is your daughter aware of this?
