so when your in the first 2 years of your licence and you get 6 points do you get banned or does your licence get taken from you and you can resit/ retake everything again ?

Penalty points gained before passing your driving test

Any penalty points you gain before passing your first driving test are taken into account. However, having six or more doesn’t mean your licence will be revoked straight after you pass your test.
Gaining further points after passing your test, taking your total to six or more, will mean your licence will be revoked.

Ok sorry if im being a bit dumb here .
I have have 3 points from when i was on my provisional/Cbt
I just passed my bike test last month
Does the above mean i will have to get 6 more points to get my licence revoked ?

My understanding is if you get 3 more points within the 2 years of passing your test then your licence will be revoked. The 3 points from your provisional are taken into account.

ok ok ..... i got my 3 points on the 27/11/2007 will these not be removed untill 27/11/2010

It makes sense really if you think about it, the paper part of your licence is ONE piece of paper:
If your get points driving the car - it goes on that piece of paper
If your get points riding the bike - it goes on that piece of paper
If your get points while its a provisional - it goes on that piece of paper

All points on all catagories accumulate on one licence, if your banned from the bike your banned from the car and vice versus. It doesnt matter if other catagories are on that licence once its taken away they're all taken away. To get the catagroies back you have to re-take everything as if its from day one. Although I dont think you'd need to take the CBT again as thats a course its not part of your licence.

EDIT: further note, once you pass everything and get it back, you've got another 2 years of careful riding to go.

If its under the 2 year rule its a bit weird. The court tells DVLA to add points to license, thats the end of their involvement, they don't ban you. The DVLA add the points, work out its over 5 in 2 years and then write to the person saying your license has been revoked and you now cannot drive from date X. You can drive until you get the letter from the DVLA. If you haven't received a letter from the DVLA saying its been revoked, you _might_ be able to argue you didn't know you were banned and be let off if caught. Be a very dodgy thing to argue though.

Maybe because the court didn't ban the friend, he didn't realise license was revoked by a letter from DVLA? If he has had his license returned with points on it from DVLA, then he got lucky and is able to drive.
