As I said, he would have been scooped until it was investigated. If it was found that he had acted purely in defence of his friend and had not committed an offence then he would, certainly here, been released without charge.

E.g. Last weekend I as backshift on the Saturday night. Turn up at a disturbance to see two guys rolling about on the floor. Both restrained and taken to station. Review of evidence and CCTV shows that although both were "rolling" about on the ground, one guy did nothing wrong at all. The other guy had smacked him several times and they both fell to the ground. Guy number 1 (good guy) then took the bad guy in a head lock to stop him hitting him anymore.

Clearly self defence and he used reasonable restraint as such, released without charge. Other guy held in custody to appear infront of Sheriff on Monday morning.

Because we don't know who has done what when we arrive at a situation like that. All we see is a group of people fighting and we don't know who is the aggressor or the victim so both have to come in til enquiries are made/cctv reviewed.

Thulfi - I'm glad we understood each other in the end (although why other people feel the need to throw random insults at me is a mystery). I was wondering today, you must have got a nasty knock to the noggin. I hope you got yourself checked out - you must know only too well how these things can cause other issues.

There is a legal right to use "reasonable force" to prevent injury to someone else or to yourself. lool, surprised it is still going on. yeeh good job we didnt end up in a fight coolgirl (lol/kiddin)..my heads ok, but ive got looads of little cuts in my mouth (one for the dentists) from when apparently they must have been doing my mouth in when i was on the floor...im a fatty, but eating is a real pain now and it sucks!

Reassuring to hear about the legal stance of this situation. You can see why the police would take everybody in, as how are they to know otherwise?...Happy it didnt come to that!...

Incidentally, if police arrive at a scene where a guy has been Ko'd (and still is) by say 3 guys, would they wait til the KO'd dude recovers then take him in, or would they bring in an ambulance then take him in,or would they not even take him in at all??

I guess the only plus to getting Ko'd on a sat nite is that i slept like a baby on Sun nite, as I was so out of it the whole of sunday, lol!...but yeeh on the whole concussions are usually no biggy...hopefully!!
