She has a baby and the NHS reward her by killing her with incompetence. Now the government wants to kick him and the child born here out. It strikes me as just too convenient that the guy is entitled to bring a damage claim against the NHS, for the death of his wife, upbringing of the child and to some degree as she was the bread winner in that household his financial future as well. Be a bit difficult for him to pursue a claim from the Philippines. There have been a lot with a lesser moral case to stay been allowed. I think this is purely for convenience of the system. I also think it amazing that there is not a system of connections that would make it impossible for a drug designed for epidural to be administered in any other manner. A bit like aircraft where plugs/sockets can only ever fit to one connection.

I guess he would. However, put yourself in his place. You loose your wife. would you not be better letting relatives care for your child whilst you fight for justice, rather than attempt to do it from 5000 miles away.
We detain people in prisons, knowing we will eventually kick them out to ensure justice is seen to be done, when it would be a damm sight cheaper to simply kick them out of the UK with a don't come back. At least give him the right to remain, his child can come back to the UK. Get the upbringing/education etc. That he would have got had somebody not cocked up.

So there goes that idea. Yes I think it is a tragic mistake, but the death of the guys wife and the Immigration issue are two completely separate issues. Both need to be dealt with separately but correctly. Permission to stay should NOT be part of some kind of compensation package.

I agree permission to stay should not be part of the compensation, that is not my argument.
He was here legally. All that has changed is that his wife was killed. and suddenly he is no longer entitled to stay. He will probably grab the compensation and live like a lord in the Philippines. However, He should be allowed to stay here to consult his legal advisers etc.

Tim's right. If the anasethetic* (sic) given in an NHS hospital hadn't been responsible for the death of his wife, the question would never arise - he's here quite legally, and thus should stay if he so wishes.

Yes he should be allowed to stay until justice/compensation has been seen.
As the case is cut and dried surely it will not require a protracted court case to decide the sum to be offered? |
