i was traveling at 38 mph in a 40mph zone. Approaching a set of traffic lights which had been green for a while expecting a yellow light soon. when it did come i hesitated unsure whether i could stop in time for white line (being a little wet) then suddenly decided to grab my front brake, i passed the white light when it was red at around 15 mph slowing down to about 8 mph. this traffic light had a camera on it and not sure if it flashed.
how long would it take for it to come through if i have got points? such a silly mistake to make but expensive on insurance none the less. |

Any fine you get through whether that be a red light jump or from a speeding fine, always argue it.
The time to pay the fine is frozen from the date of sending your complaint. Council's often have a large backlog of offenders and sometimes let you off fines and point automatically to clear that backlog. I would agree with arguing it. Sounds like you weren't taking the ****, you simply felt in the conditions you had to slow down more gradually, at which point you were over line and decided to continue because you saw nothing coming (assuming this is what you did). It is your fault in reality, but that argument might stand!

Now I may be wrong here, however...
If it's the same NIP as speeding then first you identify the driver then either accept a fixed penalty or enter a not guilty and attend court. And due to the cluster f*** that is our legal system you'll likely get a bigger shoeing if you take your day in court to which you're entitled than if you just pay it.

no inside knowledge or anything but in the past I have seen lights with camera's turn red and car's have gone through them literally as the light has gone red/maybe just a second after - and the camera hasn't flashed.
I'm not 100% but I've a feeling the induction loop for the red light camera's only activates once the red light has been red for a number of seconds, so that maybe if someone were to argue their case in court, the authorities could turn round and say "well actually the red light had already been red for xx number of seconds because that's how the system is set up, so you definitely intentionally drove against a red". Oh and n.b. the red light camera's *do* emit flash when they're triggered (as opposed to an infrared flash emission which us humans wouldn't see); I've seen a police car trigger into flashing as they drove through with lights & sirens on.

I know it's of no relevance to the OP, but in Austria the green light flashes 2 or 3 times before switching to amber. Some would argue that you shouldn't need a "warning of a warning", but in practice it works really well because you know you definitely can stop during the amber, so if the green flashes you can do it easily with no drama, takes all the "will-it-won't-it?" out of it.

No idea as to how they work, but had similar in my car a few weeks back and nothing came from it. I googled it all and came to the conclusion that the flash should be quite apparent and that there is a few seconds before they become active. The frustrating thing is that if it has got you, you have to fight to argue your case based on conditions and your safety. I worry the same as you, I have a perfectly clean license over 24 years and I would be more gutted to lose that than any fine or points would teach me. I think metalangels post on Canadas countdown is something we should adopt here, though I'm sure some would say it would encourage some to try and beat it.

I've been through several amber to red lights and they haven't flashed. I'd imagine your allowed a couple of seconds, reason being is if an articulated lorry was to go through carrying load then technically it would go off all the time.
