I was just pointing out in the example given the pedestrian would represent the car that pulled out, you seemed to compare the pedestrian with the biker.

I fully accept that filtering/overtaking (although he was overtaking not filtering) is a hazourdous activity and you should be prepared to accept responsibility if there's an accident and you are to blame.

Can I ask how the different ratios of blame would help you. I understand for your own damages but if you have a 90:10 in your favour you would still lose your NCB?

Purely my uneducated guesstimation, but I'd reckon that if you get a 90/10 in favour, your insurance co would ask if you wanted to pay the 10% or if you wanted them to. Pay it yourself, keep NCB, they pay, you pay them back next year.
