Yep, and I'd expect no less from anyone if I'm at fault partially or wholly. He didn't do his lifesaver. He said he looked in his mirror and I appeared to be at the previous corner then, 100m away I'd guess, except in reality I was much closer, maybe 5 or 6 bike lengths. The thing is, his mirrors aren't going to show back down the road once he starts to u-turn anyway.

I'm trying to remain friends, but his attitude is ****ing me off now - the next day he was out on his other bike. Today he's playing football with the lads. Bad back, huh?! He implied it's all my fault, and wouldn't even shake my hand when we left hospital.

He told me he wasn't bothering to claim on his insurance as he can get his bits for a few hundred quid on ebay, but reckons they would write his bike off if he did.

I'm pretty sure mine is a Cat C write-off. The tank alone is £600, £200 headlight and over £600 for plastics. I've given up pricing bits, it's pretty clear cut. So I'm going thru the insurance. Does that mean he would have to do the same or can he just inform them of an accident with no claim on his part? Both of us are up for renewal within a fortnight. But I'm fully comp with Protected NCB, so shouldn't take a big hit, yeah?

My big outlay is going to be leather jacket, lid and back protector. I have'nt seen my gloves since the night - but the main bit I need is a new lid, the rest I have scabby spares of sorts.

not sure about insurance, but crashing into him from behind, so to speak....doesn't that put you in a position of being at fault, as claims go. just going on things I've read previously.
Might be a difficult one.

I would have thought that him pulling in to the left and then performing a uturn across the front of oncoming traffic puts the blame squarely on the rider performing the u-turn.

how much of a mate is he, pulling out from a stationary position, (whether you were riding together or not) to do a u turn without checking teh road was clear would i feel be his fault, as plod attended and you are going through insurance anyway i'd be tempted to let the insurance battle it out. just my 2p worth.

yeah, fair point. Unfortunately its a horrid position to be in, being mates and all. Its always you vs them etc in an accident like this. Not nice to argue the blame with mates, clearly it was his fault....he'll argue otherwise, no doubt.

I think in reality it could go either way - or the insurers could spend months battling it out.

The police showed little interest. No high speeds involved. Just there to clear the road asap really. I spoke to them on the phone yesterday and they're happy to leave it as it stands. Just issued a producer each.

I have to say in my opinion the blame lays entirely with him for pulling out on you - ok so you were also in the layby, but it's surely the same principle? - he should have double checked it was clear before he made the manouevre. I'd let the insurance companies battle it out - that's what insurance is for after all, and if he doesn't like it then I suppose you just have to accept that he wasn't really a true mate
