not sure about insurance, but crashing into him from behind, so to speak....doesn't that put you in a position of being at fault, as claims go. just going on things I've read previously.

I would have thought that him pulling in to the left and then performing a uturn across the front of oncoming traffic puts the blame squarely on the rider performing the u-turn.

sorry again mate.
how much of a mate is he, pulling out from a stationary position, (whether you were riding together or not) to do a u turn without checking teh road was clear would i feel be his fault, as plod attended and you are going through insurance anyway i'd be tempted to let the insurance battle it out. just my 2p worth. get well soon, hope amanda is taking good care of you. |

yeah, fair point. Unfortunately its a horrid position to be in, being mates and all. Its always you vs them etc in an accident like this. Not nice to argue the blame with mates, clearly it was his fault....he'll argue otherwise, no doubt.

I think in reality it could go either way - or the insurers could spend months battling it out.
The police showed little interest. No high speeds involved. Just there to clear the road asap really. I spoke to them on the phone yesterday and they're happy to leave it as it stands. Just issued a producer each. |

![]() I have to say in my opinion the blame lays entirely with him for pulling out on you - ok so you were also in the layby, but it's surely the same principle? - he should have double checked it was clear before he made the manouevre. I'd let the insurance companies battle it out - that's what insurance is for after all, and if he doesn't like it then I suppose you just have to accept that he wasn't really a true mate ![]() GWS and good luck ![]() |
